Amputee gets prosthetic leg from Yeoh

AMPUTEE and father of seven children, Mohd Noor Busin can now look forward to walking and moving around freely without the aid of a wheelchair.

Mohd Noor, 68, who lost his leg in July last year due to diabetic complications, received his new prosthetic limb from Subang Jaya assemblyman Hannah Yeoh at his home in SS19 recently.
"I first saw Mohd Noor when we carried out a gotong-royong project in the area. He had applied to get a prosthetic leg from the Social Welfare Department but there was no feedback," said Yeoh.
Mohd Noor's children went to get a quotation from a clinic for the prosthetic leg and were faced with a RM7,990 bill.

"His children managed to save up RM2,000 which was not enough.
"My office offered to donate the balance of RM5,990 for Mohd Noor to have his leg in time for his son's wedding in December," Yeoh said.
She urged the Welfare Department to speed up cases such as these in future to lessen the burden of people with disabilities because the cost of prosthetic limbs is very expensive.
Mohd Noor's daughters, Nor Hamidah, 17, and Nor Hummida, 19, are very happy that their father can finally move around without the wheelchair.
"I'm very thankful for the prosthetic leg. I hope that when my father gets used to walking with the prosthetic leg and is able to take care of himself again, my older sister can find a job to help our family," said Hamidah.
At the moment, Hummida stays at home to take care of her father.
"I am very happy because things will be easier now, not just for myself but for my other family members and my father as well.
"I am also very thankful for Yeoh's help because we appealed to the Welfare Department in August but got a very late response.
"Now that my father has a prosthetic leg, I am at ease. He can go the toilet and bathe without having to sit in a wheelchair now," said Hummida.
SS19 Rukun Tetangga chairman Jamal Mohamed also thanked Yeoh for helping Mohd Noor.
"We are very appreciative of her for coming to our aid," he said.

The Penang State Government Has Instructed the State Legal Adviser to Issue a Gazette Notification Exempting Local Authorities in Penang from Section 15 of the Local Government Act 1976 as a Precursor to Seeking a Court Declaration to Compel the Election Commission to Conduct Local Government Elections

The Penang State Government has Instructed the State Legal Adviser to issue a gazette notification exempting local authorities in Penang from section 15 of the Local Government Act 1976 as a precursor to seeking a court declaration to compel the Election Commission to conduct local government elections.

The Minister for Housing and Local Government, Datuk Seri Chor Chee Heung, is reported to have said yesterday that the Penang State Government should consult with the National Council on Local Government (NCLG) before issuing a gazette notification exempting the local authorities in Penang from the provisions of section 15 of the Local Government Act 1976. Section 15 of the Act provides that all laws relating to local government elections are of no force and effect.

The Minister should be fully aware that the Penang State Government has already attempted to consult with the NCLG on the issue of restoring local government elections. On 14 July 2009, YB Chow Kon Yeow, the Penang State Exco for Local Government and Traffic Management, wrote to the Ministry of Housing and Local Government, as the secretariat to the NCLG, on this matter, but was informed on 3 August 2009 that the Federal Government had no plans to reinstate local government elections.

On 11 August 2009, the Penang State Assembly passed a resolution calling upon the Federal authorities to take action to reinstate local government elections. YB Chow again wrote to the Ministry on 24 August 2009, communicating the resolution of the State Assembly and asking for the matter to be tabled and discussed at the 62nd meeting of the NCLG. However, by its letter dated 14 September 2009, the Ministry again refused to list the topic for discussion.

A three-man legal panel consisting of Dato’ Yeo Yang Poh, Mr Tommy Thomas and Mr Malik Imtiaz was retained by the State Government, and advised that the reintroduction of local government elections was within the powers of the State, in accordance with the Local Government Elections Act 1960, which was revised in 1991.

On 4 March 2010, I wrote to the Election Commission asking it to conduct local government elections to the MPPP and MPSP, but the Election Commission also refused. On 12 March 2010, I also wrote to the Prime Minister offering to meet with him to discuss the State Government’s position but again received no response.

Between 1951 and 1965, Malaya/Malaysia practised a system of local democracy whereby local councillors were elected by local residents. In 1961, the Federal Government abolished the elected Kuala Lumpur Municipal Council, and in 1965 issued an Emergency Regulation suspending local government elections throughout the States of Malaysia, using the excuse of the Confrontation with Indonesia.

The Prime Minister at the time, Tunku Abdul Rahman, promised the Dewan Rakyat that local government elections would be restored once the Confrontation was over:

"As soon as this peace and quietness has returned we would make haste with all proper preparations for the local council elections … The very moment peace is declared I can assure this House that the elections will be held. "

The Confrontation with Indonesia ended in 1966, but local government elections were not restored as promised by the then Alliance (BN) Federal Government. In 1968, the Royal Commission on Local Government headed by Senator Athi Nahappan recommended the restoration of local government elections, but this was rejected by the Federal Government.

At the end of 2011, both Houses of Parliament passed resolutions annulling the existing Proclamations of Emergency in Malaysia, but because of sections 15 of the Local Government Act 1976, local government elections cannot be restored.

Local government is a State matter under the Federal Constitution, and the State Authority has the power under section 1(4) of the Local Government Act 1976 to exempt any local government area from any or all of the provisions of the Act. The Penang State Government has decided that 45 years after the end of the Confrontation, it is time for it to exercise its powers to free Penang and the MPPP and MPSP from the anti-democratic provisions that prevent the holding of local government elections.

As such, the Penang State EXCO has decided today to issue a gazette notification exempting the local authorities in Penang from the provisions of section 15 of the Local Government Act 1976. The Penang State Legal Adviser has been instructed to effect this gazette notification and also to issue a fiat appointing Mr Tommy Thomas to represent the Penang State Government in court. After the gazette notification, the State Government will refer this dispute with the Election Commission to the Courts.

Seksyen 15 Akta tersebut menetapkan bahawa semua undang-undang berkaitan dengan pilihan raya kerajaan tempatan adalah dibatalkan dan tidak berkuasa.

YB Menteri sepatutnya sedar dan tahu bahawa Kerajaan Negeri Pulau Pinang telah pun mencuba berkali-kali untuk berunding dengan NCLG berkenaan dengan hasrat untuk memulihkan pilihan raya kerajaan tempatan. Pada 14 Julai 2009, YB Chow Kon Yeow, Ahli Majlis Mesyuarat Kerajaan Negeri untuk Kerajaan Tempatan dan Pengurusan Trafik, telah menulis surat kepada Kementerian Perumahan dan Kerajaan Tempatan, selaku sekretariat NCLG, atas perkara ini. Susulan daripada itu, pada 3 Ogos 2009 kita telah dimaklumkan bahawa Kerajaan Persekutuan tidak berancang untuk memulihkan pilihan raya kerajaan tempatan.

Pada 11 Ogos 2009, Dewan Undangan Negeri Pulau Pinang telah meluluskan resolusi menyeru pihak Kerajaan Persekutuan untuk memulihkan pilihan raya kerajaan tempatan. YB Chow sekali lagi telah menulis kepada Kementerian pada 24 Ogos 2009 untuk memaklumkan resolusi Dewan Undangan Negeri dan meminta supaya perkara ini dibentang dan dibincangkan dalam mesyuarat ke-62 NCLG. Namun demikian, dalam surat yang bertarikh 14 September 2009, Kementerian sekali lagi enggan memasukkan topik ini dalam agenda perbincangan.

Ekoran daripada itu, Kerajaan Negeri telah melantik panel peguam yang terdiri daripada Dato' Yeo Yang Poh, En Tommy Thomas dan En Malik Imtiaz. Panel tersebut telah menasihati bahawa pemulihan pilihan raya kerajaan tempatan berada dalam bidang kuasa Negeri mengikut Akta Pilihan Raya Kerajaan Tempatan 1960 yang telah disemak semula pada tahun 1991.

Pada 4 Mac 2010, saya telah menulis kepada Suruhanjaya Pilihan Raya untuk meminta supaya pilihan raya kerajaan tempatan dijalankan bagi MPPP dan MPSP, tetapi SPR telah menolak permintaan itu. Pada 12 Mac 2010, saya juga telah menulis kepada Perdana Menteri untuk meminta perjumpaan dengan beliau untuk membincangkan pendirian Kerajaan Negeri, namun tidak menerima maklumbalas.

Di antara tahun 1951 hingga 1965, Malaya/Malaysa telah mengamalkan sistem demokrasi tempatan di mana ahli-ahli majlis telah dipilih oleh penghuni tempatan. Pada tahun 1961, Kerajaan Persekutuan telah memansuhkan Majlis Perbandaran Kuala Lumpur yang dipilih, dan pada tahun 1965 telah mengeluarkan Peraturan Kecemasan yang menggantungkan pilihan raya kerajaan tempatan di seluruh negeri-negeri di Malaysia, atas alasan Konfrontasi dengan Indonesia.

Perdana Menteri pada masa itu, Tunku Abdul Rahman, telah berjanji kepada Dewan Rakyat bahawa pilihan raya kerajaan tempatan akan dipulihkan selepas tamatnya Konfrontasi:

"Sebaik sahaja keamanan dan ketenangan pulih kembali kita akan segera membuat persiapan untuk pilihan raya kerajaan tempatan… Sebaik sahaja keamanan diisytiharkan saya memberi jaminan kepada Dewan bahawa pilihan raya akan diadakan."

Konfrontasi dengan Indonesia telah berakhir pada tahun 1966, tetapi pilihan raya kerajaan tempatan tidak dipulihkan seperti yang dijanjikan oleh Kerajaan Perikatan (sebelum menjadi BN). Pada tahun 1968, Suruhanjaya DiRaja untuk Kerajaan Tempatan yang diketuai oleh Senator Athi Nahappan telah mencadangkan pemulihan pilihan raya kerajaan tempatan, tetapi cadangan ini telah ditolak oleh Kerajaan Persekutuan.

Pada akhir tahun 2011, kedua-dua Dewan Parlimen telah meluluskan resolusi untuk membatalkan Perisytiharan-perisytiharan Darurat di Malaysia, tetapi pilihan raya kerajaan tempatan tidak dapat dipulihkan atas sebab adanya Seksyen 15 Akta Kerajaan Tempatan 1976.

Kerajaan tempatan merupakan perkara Negeri di bawah Perlembagaan Persekutuan, dan Pihak Berkuasa Negeri mempunyai kuasa di bawah Seksyen 1(4) Akta Kerajaan Tempatan 1976 untuk mengecualikan mana-mana kawasan kerajaan tempatan daripada peruntukan-peruntukan Akta tersebut. Kerajaan Negeri Pulau Pinang telah memutuskan bahawa setelah 45 tahun sejak penamatan Konfrontasi, sudah tiba masanya untuk membebaskan Pulau Pinang serta MPPP dan MPSP daripada peruntukan-peruntukan anti-demokratik yang menghalang perjalanan pilihan raya kerajaan tempatan.

Oleh itu, Majlis Mesyuarat Kerajaan Negeri Pulau Pinang telah memutuskan hari ini untuk mengeluarkan pemberitahuan warta yang mengecualikan pihak-pihak berkuasa tempatan Pulau Pinang daripada peruntukan-peruntukan Seksyen 15 Akta Kerajaan Tempatan 1976. Penasihat Undang-undang Negeri Pulau Pinang telah diarahkan untuk mengeluarkan pemberitahuan warta ini dan juga untuk mengeluarkan fiat melantik En Tommy Thomas untuk mewakili Kerajaan Negeri Pulau Pinang di mahkamah. Selepas pemberitahuan warta, Kerajaan Negeri akan merujukkan perkara ini kepada Mahkamah.

房屋及地方政府部长拿督斯里曹智雄今天说,槟州政府在宪报上发出通令,让槟州所有地方政府免于实施地方政府法令第15条文之前,应该咨询国家地方政府理事会。第15条文宣判所有与地方政府选举有关的法令皆为无效。

部长应该知道,槟州政府已经咨询过国家地方政府理事会有关恢复地方选举的课题。2009年7月14日,槟州行政议员(地方政府兼交通管理委员会主席)曹观友已经就此致函房屋及地方政府部(国家地方政府理事会秘书处),但是,我们在2009年8月3日接获当局的答复,说明联邦政府并没有计划恢复地方政府选举。

2009年8月11日,槟州州议会动议并通过,要求联邦政府恢复地方议会选举。曹观友再一次于2009年8月24日致函部长,说明有关州议会的动议,并要求在第62次国家地方政府理事会议上提呈及讨论。但是,房屋及地方政府部于2009年9月14日,再一次拒绝将有关动议列为讨论事项。

州政府也找来三名律师拿督杨文波、汤米汤姆斯、玛力英迪亚斯,他们建议我们行使州政府的权力,重新根据1960年地方政府法令(1991年修正),举行地方议会选举。

2010年3月4日,我代表槟州政府写信给选举委会员,要求选委会执行槟岛市政局及威省市政局的地方议员选举,但是选委会却拒绝这项要求。2010年3月12日,我再次致函首相,要求与他见面阐明州政府的立场,依旧是石沉大海。

在1951至1965年期间,马来亚/马来西亚曾经实施过地方议会民选制,让居民选出县市议员。1961年,联邦政府废除吉隆坡民选的市政府,1965年颁布紧急条例,宣布中止全马各地的地方政府选举,理由是当时正值马印对抗。

当时的首相东姑阿都拉曼在国会中承诺,一旦马印对抗结束,政府将恢复地方议会选举,他说:

"只要和平与宁静的时刻到来,我们会即刻筹备地方政府选举… ..一旦和平到来,我向国会保证,我们将重新举行地方政府选举… …"

马印对抗于1966年结束,但是,当年联盟(后来的国阵)所承诺的地方政府选举至今还没有恢复。1968年,由上议员阿迪纳哈班所率领的地方政府皇家委员会曾提议恢复地方政府选举,但是联邦政府却拒绝他的建议。

2011年底,国会通过废除我国现有的紧急条例,但是,由于1976年地方政府选举第15条文尚存,地方政府选举不能恢复执行。

在联邦宪法底下,地方政府属于州管辖事务,而州政府有权力在1976年地方政府法令第1(4)条文下,免除地方政府遵从上述法令中的任何一项或所有条文。槟州政府决定,马印对抗已经结束了45年,是时候由州政府把槟岛市政局和威省市政局从阻碍地方政府选举、反民主的法律条文中解放出来。

因此,槟州行政议员今天决定,在宪报上颁布通令,让槟州所有地方政府可以免于实施1976年地方政府法令第15条文。州法律顾问受指示颁布通令,并发出委任指令,由汤米汤姆斯成为州政府的代表律师。一旦通令颁布,我们将在法庭上,解决与选举委员会在地方选举课题上产生的争论。

Chua Soi Lek Should State Which Seat He Is Standing In The Next General Elections So That We Can See His Response If DAP Does A "Liow Tiong Lai Act" By Declaring Confidence Of Beating Chua.

MCA President Datuk Seri Dr Chua Soi Lek should state which seat he is contesting in the next general elections so that we can see his response if DAP does a "Liow Tiong Lai act" by declaring confidence in defeating Chua. DAP is not interested in playing the boastful games of MCA, when the only one making political challenges is the MCA and not DAP.

I wish to remind MCA President Chua Soi Lek that MCA's Health Minister Liow Tiong Lai is the only one who issued a political challenge by boasting that MCA is confident of winning my present parliamentary seat of Bagan. When asked by Malaysian Insider I said that,

"I will not comment further on Liow's challenge unless Liow Tiong Lai himself or MCA Vice-President and Penang MCA Chair Ng Yen Yen is contesting in Bagan. Let Liow continue his boastful remarks. I will not indulge in MCA's boastful games as I wish to focus on serving the voters in my constituency and the people of Penang."

Unlike MCA, DAP has not engaged in political games by boasting we will win or beat Liow in Bentong or Ng Yen Yen in Raub. Only MCA is making all these boasts. We therefore hope that Chua Soi Lek will stop deceiving the public on this matter. Will Chua Soi Lek dare to announce which seat he is contesting, then let me go to that constitutency and repeat Liow's remarks that we are confident of defeating Chua then see how Chua will respond?

This is not the first time that the MCA President has failed to keep his promise, during his political comeback after his resignation for personal reasons, that he will not again deceive the people especially those around him. Chua had lied of PR and DAP mismanaging the financial administration of Penang resulting in budget deficits.

This is typical of MCA's deceptive politics where black becomes white and white become black. Penang has no budget deficits but had recorded budget surpluses every year for the four years we are in power, certified by the Auditor-General Report. In fact Penang remains the only state in Malaysia to be praised by Transparency International for our efforts in implementing open tender to battle corruption.

行动党不像马华,我们没有说我们会在文冬打败廖中莱胜出、或在劳勿打败黄燕燕胜出。只有马华一直在吹牛。我希望蔡细历不要再欺骗公众。蔡细历敢不敢公布他要上阵的议席,然后让我去那个选区,像廖中莱那样说"我们有信心打败蔡细历",看看蔡细历怎么回应?

这不是第一次马华总会长无法兑现他的诺言,在他因私人理由辞职后,他再也骗不了人民,特别是他身边的人。蔡细历也说谎,指民联和行动党治理的槟城财务管理不当,导致预算赤字。

这就是典型的马华欺骗政治,黑的可以讲成白的,白的也可以讲成黑的。槟城不但没有预算赤字,我们还连续四年取得预算盈余,总稽查司也认同这一点。事实上,目前为止,槟城还是唯一因实施公开招标、打击贪污而被国际透明组织称赞的州属。

而无法工作。但是原以为伤势开始好转当儿,上星期一却被诊断患了第四期鼻癌,让一家5口

(雪蘭莪‧巴生13日訊)班達馬蘭巴板路和武吉克拉容的木屋區問題至今仍懸而未決,雖然居民獲獻議以9萬9千令吉的價格購買新屋子作為搬遷的條件,但基於居民財力有限,因此希望屋價可以再調低。

巴生區國會議員查爾斯表示,受影響的巴板路和武吉克拉容居民已多次跟掌管木屋的雪州行政議員依斯甘達、發展商等各造開會,而在去年6月左右,雪州經濟行動理事會經過協商後獻議以20X70呎、售9萬9千令吉的屋子,作為居民搬遷的條件。

大多數居民逾60歲

然而,他說,絕大多數的巴板路和武吉克拉容居民都年逾60歲,要向銀行貸款買屋子非常困難,因此居民希望州政府調低9萬9千令吉的獻議價。

此外,他表示,雪州政府於1997年把巴板路和武吉克拉容的土地轉移給國家銀行子公司TPPT時,是根據3個條件,如果如今以9萬9千令吉的屋子作為要求居民搬遷的交換條件,恐怕會違反了多年前談妥的3個條件。

查爾斯今日在新聞發佈會指出,這3個條件包括TPPT必須有穩固的財力、非盈利至上及肩負社會責任。

范新麟:致函大臣要求調低屋價

另一方面,代表巴板路和武吉克拉容木屋居民的律師範新麟表示,他的律師行已致函給雪州大臣丹斯里卡立,提出調低屋價的要求。

他說,9萬9千令吉只是建議價格,並非最後的定價,所以還有協商的空間。

徐志榮:未安頓住處已動工打地基

另外,武吉克拉容搬遷委員會主席徐志榮表示,受影響的住戶至今仍未獲得安頓,但發展商從大約去年8月開始,就已動工打地基。

他指出,受影響的武吉克拉容住戶在當地定居已有70年,如今眼見工程已展開,他們未來的安身之所卻仍然沒有著落,令他們擔憂不已。

除了武吉克拉容有25個單位受影響之外,巴板路也有150個單位受影響。

張玉月:快安頓受影響住戶

巴板路居民代表張玉月說,巴板路和武吉克拉容的木屋搬遷問題已拖延了十多年還未解決,希望州政府以居民利益為優先,儘快安頓受影響的住戶。(星洲日報/大都會)
