Roads in Kuala Lumpur suffer from bad resurfacing jobs

One of the main grouses often heard about Kuala Lumpur is the many potholes on its roads.
Whether in residential or commercial areas, travelling around the city often means a bumpy ride because of the potholes and badly patched stretches of roads. In many places, roads in good condition are dug up by utility and telecommunications companies for the laying of pipes and cables. They are then badly resurfaced.
In April, Segambut MP Lim Lip Eng had highlighted at least six places in his constituency where roads were dug up without a permit.
A spokesperson from the Kuala Lumpur City Hall (DBKL) corporate communications department confirmed that there have been cases where contractors operate without approval from DBKL. "If we find out that they have no permit, we will contact the respective companies. If the dug-up areas have not been patched up or resurfaced, we will do it for them them and issue them the bill. "We have also found out that many contractors appointed by the companies have no expertise in resurfacing roads," he said. He also urged residents who suspect that roads were being dug up without permits to call 1800-88 3255.
StarMetro spoke to the major utility and telco companies in Malaysia to find out their procedures for installing pipes or cables.
Syabas
Syarikat Bekalan Air Selangor Sdn Bhd (Syabas) corporate affairs department executive director Abdul Halem Mat Som said they have a standard operating procedure for contractors assigned to dig up roads to install pipes. "They have to follow it and some even complain that our procedures are too strict," he said. Halem added that they sometimes needed a day before they could resurface a road because the soil has to settle after laying the pipes. "Some contractors for smaller projects might try to take the easy way out but we will take action against them if they are found guilty of violating our procedures," he said.
Telekom Malaysia
Chief technology and innovation officer Girgio Migliarina said TM will submit proper work permit applications to the local authorities before any civil or cabling works that require excavation on road surfaces, pavements or even on grass can commence. All civil and cabling works are carried out by TM's registered panel of contractors who have undergone the required training and certifications but permit application is carried out by TM directly. In the case of DBKL, a joint site inspection by DBKL officers and TM staff will be carried out to determine the exact location of the work site. "We have to pay processing fees and a bank guarantee before the permit can be approved. Our contractors will then commence work in accordance with the approved work method, working time and project schedule. "Works are supervised by TM Project Supervisors to ensure that they are carried out according to specifications and that the site has been cleared and the dug-up road properly resurfaced. Our contractors will then carry out road milling and paving works according to the requests and needs of the local authorities up to their satisfaction," said Migliarina. If the local authorities are not satisfied with the work, they can appoint their own contractors to carry out the resurfacing, milling and paving. The claims for these work can be deducted from the telco's bank guarantee.
Celcom
In an official statement by the company, Celcom said the contractors for digging up of roads and laying cables are appointed from a list of panel chosen based on a stringent tender process. Celcom generally applies for permits directly from the local council but in some cases, contractors also apply for the permits. Upon approval of the work permit, the appointed contractor will be informed of the schedule for the execution of the work and Celcom supervises all activities during the period to ensure that all the procedures and rules are complied with. It is the contractor's responsibility to resurface the road and there is a requirement for re-doing in case of unsatisfactory workmanship after inspection by the local authority. Procedures are also in place to ensure that the quality of workmanship will be maintained for at least up to a one-year period. Upon completion of the project, the contractors will need to get all the necessary signed documents from Celcom, confirming that they have fully completed the project as per stated in the contract. Any contractor who fails to carry out the duty will be blacklisted for any new job appointment and a new contractor will be appointed to rectify any pending repair works.
Maxis
A company spokesperson said Maxis complied to stringent guidelines in the laying of cables for network rollout. "We ensure that approvals are obtained before roadworks commence. We do not compromise on any aspect of work that may affect the community. "We monitor the quality of work via regular site visits to ensure that it is in compliance with the standard and procedures of the relevant local authorities," she said. DiGi only offers mobile services which do not require them to dig up roads to install connecting cables to housing and commercial areas.
However, Tenaga Nasional Berhad did not respond to queries from StarMetro.

Menaikkan Hasil Tanah PDC Sebanyak 6 Kali Ganda Menerusi Sistem Tender Terbuka Dengan Harga Rezab oleh Kerajaan Negeri Pakatan Rakyat Pulau Pinang (bm/cn)

KENYATAAN MEDIA YAB LIM GUAN ENG, KETUA MENTERI PULAU PINANG SEMPENA MAJLIS MENANDATANGANI PERJANJIAN PAJAKAN LOT 836 MUKIM 12 JURU SEBERANG PERAI TENGAH ANTARA PDC DENGAN WEI LEAN AQUACULTURE SDN. BHD. BAGI TUJUAN PROJEK PERTANIAN KOMERSIL.

1.1 PDC mempunyai sebidang tanah iaitu Lot 836, Mukim 12, Daerah Seberang Perai Tengah yang seluas 102.8123 ekar. Sejak 1995, PDC telah memajak tanah kepada pihak swasta tetapi bukan secara tender terbuka dengan harga rezab.

1.2 PDC telah memutuskan untuk memajak selama 15 tahun kepada pihak-pihak yang berminat bagi melaksanakan projek pertanian komersil agar dapat memberi pulangan yang lebih tinggi kepada PDC.

1.3 Sehubungan itu pada 10 Mei 2010 PDC telah membuka tender pajakan Lot 836 dengan penetapan harga rezab mengikut nilaian daripada Jabatan Penilaian dan Perkhidmatan Harta (JPPH) seperti berikut:-

i) Sewa Tanah RM29,000 sebulan (RM282/ekar/bulan)
ii) Pembelian aset tetap RM632,400 yang terdiri daripada :-

a) 2 buah kandang kambing
b) 4 buah rumah fertigasi
c) Sebuah bangunan pejabat
d) Peralatan pertanian
e) Peralatan dan perkakasan pejabat
f) Sebuah Land Rover

Aset tetap di atas lot 836 adalah yang dibina atau dibeli oleh PDC Agrotech Sdn. Bhd. sejak syarikat tersebut mengambil alih pengurusan lot tersebut.

1.4 Pada tarikh tutup tender iaitu 14 Jun 2010, hanya dua (2) buah syarikat sahaja telah mengambil bahagian. Walau bagaimanapun tawaran yang diterima adalah jauh lebih rendah daripada harga rezab yang ditetapkan, maka Lembaga PDC dalam mesyuaratnya pada 20 Julai 2010 telah menolak kedua-dua tender tersebut. Lembaga seterusnya memutuskan supaya PDC membuka tender baru.

1.5 Sehubungan itu pada 21 Oktober 2010, PDC telah sekali lagi membuka tender pajakan lot 836. Pada tarikh tutup iaitu 9 Disember 2010, terdapat 11 buah syarikat telah mengambil bahagian. Namun begitu harga tawaran daripada syarikat-syarikat tersebut juga didapati lebih rendah daripada harga rezab PDC. Oleh itu pada 17 Mac 2011, Lembaga Tawaran telah memutuskan untuk menjemput semula semua syarikat yang telah mengambil bahagian untuk mengemukakan tawaran akhir (final offer). Keutamaan akan diberikan kepada syarikat yang menawarkan harga sama atau melebihi harga rezab tersebut.

1.6 Pada tarikh tutup iaitu 11 April 2011, hanya 7 buah syarikat yang mengemukakan tawaran akhir dengan Syarikat Wei Lean Aquaculture Sdn. Bhd. telah menawarkan harga tertinggi iaitu RM33,928 sebulan bagi sewa tanah dan RM4,000 sebulan bagi aset tetap. Ini menjadikan jumlah sewa sebulan yang ditawarkan oleh Syarikat Wei Lean Aquaculture Sdn. Bhd. ialah RM37,928 atau berjumlah RM6,827,040 untuk tempoh 15 tahun..

1.7 Syarikat Wei Lean Aquaculture Sdn. Bhd. merupakan sebuah syarikat yang berpengalaman luas dalam bidang ternakan ikan dan udang. Syarikat ini mencadangkan untuk menjalankan aktiviti ternakan ikan dan udang di atas lot 836 sebagai aktiviti pertanian komersil yang utama.

1.8 Berdasarkan pengalaman yang ada dan keupayaan kewangan yang baik, PDC yakin Syarikat Wei Lean Aquaculture Sdn. Bhd. akan berjaya melaksanakan projek yang dicadangkan dengan jayanya dan mampu menjelaskan bayaran sewa kepada PDC mengikut syarat perjanjian yang ditetapkan.

1.9 Atas keyakinan tersebut, pada 20 April 2011, Lembaga Tawaran telah bersetuju untuk menawarkan pajakan lot 836 kepada Syarikat Wei Lean Aquaculture Sdn. Bhd. selama 15 tahun bagi tujuan aktiviti pertanian komersil.

1.10 Dengan termerainya perjanjian pajakan pada hari ini, membuktikan bahawa PDC sekali lagi telah memcapai kejayaan dalam mengoptimakan hasil daripada projek-projek yang dijalankan. Jika dibandingkan dengan jumlah hasil sebulan setakat RM6,920 sebelum ini, sistem tender terbuka yang diamalkan oleh Kerajaan Negeri PR Pulau Pinang telah membolehkan PDC menaikkannya sebanyak enam kali ganda kepada RM37,928 sebulan. Untuk tempoh 15 tahun, hasil PDC akan berlipat ganda kepada RM6,827,040.

1.11 Kegagalan Kerajaan BN lama yang tidak mengamalkan sistem tender terbuka secara kompetitif dengan harga rezab sebelum ini, telah mendatangkan hasil yang jauh berkurangan iaitu sekadar 1/6 sahaja. Inilah kejayaan dasar CAT yang diamalkan oleh Kerajaan Negeri dan PDC pada masa ini.

RINGKASAN HASIL KUTIPAN SEWA LOT 836, JURU

槟州民联政府透过公开招标,成功为槟州发展机构带来比底价高出6倍的土地收益。
1.1 槟州发展机构在威中巫金12的836号地段,拥有一片面积102.8123依格的土地。自1995年开始,槟州发展机构一直租给私人界,但是以底价,而不是公开招标。
1.2 槟州发展机构决定将这块地段出租15年给那些有兴趣进行商业务农者,以为槟州发展机构取得更高的回酬。

1.3 同时,在2010年5月10日,槟州发展机构已经用资产评估与服务局所估计的固定底价进行公开招标,出租836号地段:

i) 土地出租每月2万9000令吉(每月每英亩282令吉)
ii) 固定资产收购价63万2400令吉:-

a) 两个羊栏
b) 4座加肥灌溉屋
c) 一座办公室
d) 务农工具
e) 办公室配备
f) 一辆Land Rover多用途越野车

在836地段上的资产是槟州发展机构AGROTECH公司接管有关地段的业务时兴建或购买的。

1.4 在招标日期于2010年6月14日截止后,只有两家公司参与竞标。虽然如此,我们所收到的投标价比底价还低,因此,槟州发展机构董事局在2010年7月20日的会议上拒绝上述两份竞标,并决定重新招标。

1.5 此外,在2010年10月21日,槟州发展机构再次公开招标出租836地段。2010年12月9日竞标截止时,有11家公司参与竞标。但是,这些公司的投标价还是低过槟州发展机构的底价。在2011年3月17日,竞标局决定重新邀请所有参与竞标的公司提呈最后的投标。我们会优先考虑投标价等同或超过底价的公司。

1.6 到了2011年4月11日,只有7家公司提呈最后投标价,威联水产饲料市场有限公司提出最高的投标价,即每月3万3982令吉租金及固定资产租金每月4000令吉。这让上述公司的每月可缴付的租金达3万7928令吉,或15年总共682万7040令吉的租金。

1.7 威联水产饲料市场有限公司是一家非常有经验的鱼虾饲养公司。这家公司建议在上述地段进行以鱼虾饲养为主的商业务农。

1.8 有鉴于上述公司拥有良好经验与财务能力,槟州发展机构相信威联水产公司将会成功的进行他们的计划,并根据合同的规定缴清租金。

1.9 2011年4月20日,竞标局决定将836地段的租约颁给威联水产公司长达15年,以进行商业务农活动。

1.10 随着合约的签署,再次证明槟州发展机构已经成功地将所有计划的收益最大化。与之前每月6920令吉的收入相比,槟州政府的公开招村让槟州发展机构的每月收入增加了6倍,达3万7928令吉。接下来15年,槟州发展机构的收入也将乘倍增加到682万7040令吉。

1.11 前朝国阵政府没有善用底价,推行具竞争力的公开招标,因此只赚了六分之一。这是州政府与槟州发展机构目前推行能干、公信及透明政策的一项成就。

1Malaysia Another Empty Slogan When Being A Malay First, Chinese First Or Indian First Is More Important Than Malaysian First.

The sorry spectacle of the National Registration Department (NRD) refusing to allow DAP State Assemblywoman for Subang Jaya Hannah Yeoh and her husband Ramachandran Muniandy to register her new born child as ‘Anak Malaysia’ as an official ethnicity, shows that 1Malaysia. Clearly BN is so racist that being a Malay First, Chinese, First or Indian First is more important than being a Malaysian First.

DAP is proud of both Hannah and Ramachandran for living and practicing DAP's Malaysian Malaysia and Malaysian First spirit that we are all inextricably bound together by our common destiny as one nation. By deliberately forcing us into ethnic boxes BN is not celebrating diversity nor creating a common Malaysian identity, but opportunistically playing divide and rule politics.

We should look beneath the different colours of our skin and discover that our blood is red. We should look past one's ethnicity and discover our common Malaysian heritage. We should look beyond one's race and discover that we are all members of the human race.

Full Support For Hannah And Ramachandran's Quest For Their Child To Be Simply Known As Malaysians.

Forcing Hannah and Ramachandran to choose either Indian or Chinese is repugnant when they just want their child to be known as Malaysian. Hannah and Ramachandran has striven to let Malaysians see that we should never allow BN to corrupt young minds with obsolete and dangerous racist ideology that one's child is never good enough and must be forever dependant on the tongkat or that they will never be rewarded for their good performances no matter how deserving they are just because they come from a certain race.

DAP would give full support to Hannah and Ramachandran's quest for their child to be simply known as Malaysians. If both wants to pursue in court, I have directed DAP National Legal Advisory Committee Chair and MP for Puchong Sdr Gobind Singh to handle the case.

Ultimately, it is not who we are that is important, but what we are that is important; not the colour of our skin that is important but the content of our character; and not our past ancestry that is important but how we connect with the present and with each other to face the future.

当局强迫杨巧双和拉玛詹德拉选择让孩子成为印度人或华人是矛盾的,他们只是要自己的孩子成为马来西亚人。他们两夫妻的挣扎让马来西亚人看到,我们不应该让国阵用迂腐和危险的种族理念,侵蚀年轻一代人的思维,让他们一直以为,因为自己是某个种族,他们永远不够好,必须依赖拐仗;又或者因为自己是某个种族,他们无论多么努力,他们都无法获得奖赏。

DAP National Deputy Chairman and MP for Kepong Dr Tan Seng Giaw reiterates that effective enforcement is important in controlling inflation.

On 8.6.2011, Dr Tan notes that the Ministry of Domestic Trade and Consumer Affairs has set up 1 Malaysia Pengguna Bijak (1MPB) portal for consumers to compare prices of goods in 1,255 outlets in Malaysia.

The recent increase in electricity tariff by 12.17% puts pressure on inflation in the country. Despite the Government saying that the prices of goods will not increase,the people are cautious. They are aware that inflation is due to many factors.

If consumers can look at the above-mentioned portal and compare the prices of goods, it may help. On the other hand,the Government has to be seen to be fair and to be able to enforce various measures effectively.

To have effective enforcement, we require a clean and trustworthy government. The people have an important part to play to bring about good governance.

BN Government "Powerless" to Protect Rakyat

The reluctance of the Government to make public the PPAs shows that it is "powerless" when needed to protect the interest of the rakyat, but "powerful" where maximising the profits of IPPs are concerned

The Minister of Energy, Water and Green Technologies, Datuk Peter Chin had earlier in the week expressed that the Government is helpless in "declassifying" the Power Purchasing Agreements (PPAs) between the Independent Power Producers (IPPs) and Tenaga Nasional Bhd (TNB) in the light of the demand by the public.

The Ministry's reply to me back in 29 February 2009 for my parliamentary question said the exact same thing, which at the very least showed that they are steadfast and consistent in backing the interest of the IPPs.

The Minister then had replied to me that "dokumen Perjanjian Jual Beli Tenaga (PPA) merupakan satu dokumen perjanjian antara dua entiti swasta, iaitu di antara Tenaga Nasional Berhad (TNB) dan pihak penjana bebas (IPP) yang terbabit. Di bawah perjanjian tersebut, kedua-dua pihak perlu memberikan persetujuan terlebih dahulu sebelum mana-mana kandungan perjanjian tersebut boleh diumumkan. Sekiranya pihka TNB bercadang untuk menamatkan perjanjian PPA tanpa sebab yang kukuh, TNB perlu memberi pampasan penuh kepada pihak IPP."

The Ministry's reply to me on 23 March 2010 again emphasized the Government's sheer reluctance to right the wrong in the PPAs which make the rakyat pay significantly more for its electricity.

"Kerajaan sentiasa menghormati sebarang perjanjian atau kontrak yang telah ditandatangani oleh pihak Kerajaan. Oleh yang demikian, Kerajaan tiada rancangan untuk merombak semula atau menamatkan kontrak Perjanjian Pembelian Tenaga (PPA) secara unilateral dengan pihak IPP sebelum tamat tempoh kontrak tersebut. Sebaliknya, pendekatan yang diambil oleh Kerajaan ialah supaya PPA tersebut dirundingkan semula.Memandangkan rundingan semula PPA merupakan perkara yang rumit dan memerlukan tempoh masa yang agak lama untuk menentukan hasilnya, ia akan ditangani secara berasingan."

The "powerless" nature of the BN government when it comes to declassifying and renegotiating the PPAs, is in direct contrast to the "powerful" role it played to ensure that the IPPs were ensure astronomical profits.

In a revealing interview published by The Star on 26 June 2006, former TNB chairman, Tan Sri Ani Anope who was "involved" in the power agreements with the IPPs had said:

"There was no negotiation. Absolutely none. Instead of talking directly with the IPPs, TNB was sitting down with the EPU. And we were harassed, humiliated and talked down every time we went there. After that, my team was disappointed. The EPU just gave us the terms and asked us to agree. I said no way I would."

As for the pricing and terms of the contracts, "It was all fixed up. (They said) this is the price, this is the capacity charge and this is the number of years. They said you just take it..."

Hence when TNB was forced to sign these lobsided PPAs, it was the Prime Minister's all-powerful Economic Planning Unit (EPU) which dictated all terms. But when it comes to making public these PPAs, its now TNB's own choice as a "private company" and there's not the Government can do about it.

The responses from the Minister are at best "misleading" and at worst a lie, for the Government has a vested interest in not declassifying these contracts, for it was the BN government itself who dictated the terms of these contracts to be signed. Now it just does not want the public to know what it did, and the fact that it prioritised the astronomical profits of these IPPs at the expense of the man-on-the-street.

In fact Tan Sri Ani Anope disclosed that an agreement has been struck between TNB and an IPP, understood to be Genting Sanyen for the former to purchase electricity at 12 sen per kWh. However the "EPU said that unless the IPP raised its price, the contract would not be given to the IPP. So he got it for 14 sen per unit," while other first generation IPPs got 16 sen per kWh.

Now that the interest of the IPPs have been served, the Government reverts to its meek and timid role using the excuse that its an agreement between "private entities" and that any renegotiations can only be done after the existing contracts expire.

On the contrary, as there is no "contract" between the Government and the rakyat, the Government can choose to raise electricity tariffs any time it so chooses, even if it were to mean that these IPPs were to continue to profit at the expense of increased sufferings of the rakyat.

The Prime Minister, Datuk Seri Najib must demonstrate moral and economic leadership by doing what is right and just for the people, instead of dithering over the declassification of the PPAs as well as their renegotiation. Otherwise, all the rhetoric of "transformation" becomes just a facade for continuity and business as usual, where political cronyism comes first.
