Anwar Won Defamation Against Nallakaruppan Over “Receiving RM60 Million” Claim

Anwar Ibrahim has won a defamation suit against Nallakaruppan ,the High Court ruled this afternoon at the Sivil Court 7, at Kuala Lumpur High Court at Jalan Duta

After hearing submission in chambers by both counsels for Anwar and Nalla,  High Court Judge YA Justice Dato’ Su Geok Yiam struck off the Defendant’s Statement of Defence on the grounds that it was frivolous, vexatious and tantamount to an abuse of court process.

Anwar’s lawyers filed in an application to strike off the Statement of Defence by Nallakaruppan after the latter had failed to furnish particulars as directed by a court order made on 28.8.2009 to provide further and better particulars to the allegations made by him.

The court then entered Judgment of liability against Nallakaruppan for his libellious and defamatory allegations that Anwar had purportedly received RM60 million in cash taken from Magnum Corporation. The allegation was made by Nallakaruppan on 23 August 2008 was published in Mingguan Malaysia under the article entitled “Didakwa Terima 60Juta.”

The Court further directed the damages to be paid by Nallakaruppan to Anwar and quantum will be assessed before the Court’s Registrar.

The decision was made in the judges' chambers, Justice Dato’ Su Geok Yiam rejected Nallakaruppan’s defence of justification,  fair comment and qualified privilege.

Anti-Lynas Group Demands Right to Address Parliament

The Save Malaysia Stop Lynas (SMSL) group today protested outside Parliament, demanding the right to speak in the Dewan Rakyat.

SMSL chief Tan Bun Teet said this was necessary because the House could provide immunity for them to speak out against Lynas.

“If we speak without immunity, we will affect our case as Lynas has filed a defamation suit against us,” Tan said.

The protest by some 100 people at the Parliament entrance came ahead of the debate on the report of the parliamentary select committee on the Lynas Advanced Materials Plant (Lamp).

As some MPs drove in to Parliament, they lowered their windows and gave the group thumbs up while others honked in support.

They were later met by a group of MPs led by Sungai Siput MP Dr Michael Jeyakumar Devaraj, who escorted them into the Parliament building.

Addressing the media later, Tan said group had requested for immunity during the PSC hearing in Kuantan but was turned down.

“Because of this, we had to walk out because we could not reveal the truth about Lynas should there be is a court case,” he said.

‘PSC report a foregone conclusion’

Tan also criticised the PSC report, pointing out that it was a forgone conclusion as the panel chief led by Higher Education Minister Mohamed Khaled Nordin had described Lamp as safe even before the committee concluded its work.

Lynas had on April 20 filed a lawsuit against SMSL for “false and misleading” statements made against Lynas through news portal Free Malaysia Today, which was also named in the lawsuit.

The SMSL group arrived at Parliament House today from the Kuala Lumpur High Court complex to attend the case, which has since been postponed to July 19.

Meeting the group earlier, Lembah Pantai MP Nurul Izzah Anwar said they will work to get time for Tan to speak in the House, even though it is not likely to be allowed.

“Parliament is normally for MPs to speak. Our bid is likely to be rejected but I will still try and bring it up with Minister in the Prime Minister’s Department Nazri Abdul Aziz,” Nurul Izzah said.

However, she assured the group that their concerns would be raised during the debate.

Peneroka cabar pelantikan Isa Samad

Satu semakan kehakiman difailkan ke atas keputusan Suruhanjaya Koperasi Malaysia (SKM) membenarkan pelantikan pengerusi Felda Tan Sri Isa Samad sebagai ahli lembaga dan pengerusi Koperasi Permodalan Felda (KPF).

Semakan kehakima yang difailkan empat peneroka Felda - Abdul Talib Ali, Abdul Mubin Abdul Rahman, Abdul Razak Mohammad dan Muhamad Nor Atan - menamakan KPF, SKM dan satu jawatankuasa suruhanjaya sebagai responden dalam permohonan berkenaan.

Permohonan kepada Mahkamah Tinggi Kuala Lumpur itu bagi menyemak semula keputusan SKM yang membenarkan Isa dilantik ke dalam KPF, walaupun mengetahui bahawa pelantikan tersebut tidak sah.

Permohonan yang difailkan melalui firma Mohamad Hanipa & Associates itu juga menuntut supaya pelantikan dan keahlian Isa dalam KPF ditangguhkan sementara sehingga keputusan semakan kehakiman itu diperolehi.

Empat peneroka berkenaan turut menuntut perintah untuk membatalkan keputusan SKM bagi membatalkan pelantikan Isa.

Peneroka itu menuntut ganti rugi am, ganti rugi teruk dan teladan atas tindakan tersebut.

Pada 23 Mei lalu, SKM dan jawatankuasa berkenaan mendapati KPF melanggar satu undang-undang kecil dengan membenarkan keanggotaan Isa, namun memutuskan bahawa keahlian itu tidak boleh dibatalkan kerana tiada undang-undang yang memperuntukkan perkara itu.

KUALA LUMPUR 18 Jun: Cadangan menaikkan had umur persaraan pekerja swasta kepada 60 tahun bertujuan melengah-lengahkan pengeluaran caruman Kumpulan Wang Simpanan Pekerja (KWSP).
Pengerusi Biro Pekerja KEADILAN, Abdullah Sani Abdul Hamid berkata, langkah itu memudahkan Umno BN
menggunakan sewenang-wenangnya caruman KWSP untuk survival politik mereka.

"Pada masa ini, had umur mengeluarkan KWSP adalah 55 tahun. Apabila dinaikkan persaraan kepada 60 tahun, had umur
pengeluaran KWSP juga akan dilanjutkan.

"Apabila lebih banyak wang terkumpul, maka wang itu akan disalah guna untuk dilabur dalam syarikat kroni mereka,"
katanya.

Menurut Ahli Parlimen Kuala Langat itu lagi, penyalahgunaan wang KWSP terbukti apabila Perdana Menteri sewenang-
wenang menggunakan RM75.3 bilion dana awam itu untuk melabur di luar negara pada tahun lalu.

Katanya, wang tersebut sekiranya dilaburkan di dalam negara boleh membina rumah kos sederhana atau mampu milik yang memberi manfaat kepada pencarum.
"Hutang negara pada masa ini dianggarkan berjumlah RM456 bilion. Kalau RM75.3 bilion itu dilaburkan dalam negara ia
membantu mengembangkan ekonomi," ujarnya yang juga Ketua Kaukus Pekerja Parlimen Malaysia.

Abdulah juga mempersoal sama ada golongan pekerja masih dilindungi Pertubuhan Keselamatan Sosial (Perkeso) jika had umur persaraan dinaikkan kepada 60 tahun.
Mengulas isu sama, bekas Presiden Kongres Kesatuan Sekerja Malaysia (MTUC), Syed Shahir Syed Mohamud membidas
istilah 'persaraan' yang digunakan oleh kerajaan kepada pekerja sawsta.

"Kalau sektor swasta, mereka mendapat wang KWSP bukan wang pencen. Istilah ini suruh dia (Najib Razak) perbetulkan
dahulu. Istilah yang betul adalah 'tamat tempoh usia perkhidmatan'," katanya.

Bagaimanapun, beliau tidak menolak tempoh perkhidmatan swasta dinaikkan kepada 60 tahun asalkan ia dilaksanakan
secara adil dan tidak menjejaskan kebajikan pekerja bawahan.
