‘Charge brother’s attacker with manslaughter’

Ng Wai Keong, a disabled person who wandered the streets around Pudu crawling on his arms, died after being assaulted by a man who refused his request for a cigarette. Speaking at a press conference here today, the deceased's brother said the suspect who allegedly attacked Wai Keong, 59, with a huge cane was only charged for "causing hurt with a weapon".
"How is it possible that my brother was beaten to death but the person responsible was not charged for murder or manslaughter? "You say that his cause of death was inflammation of the lungs, but how did he end up in the ICU if he wasn't attacked in the first place?" asked Ng Wai Cheong, 51, a contractor. "I want a heavier charge against the person who killed my brother," he said, adding that the charge should at least be under Section 304 of the Penal Code for manslaughter. He said that several witnesses saw the attacker leave the scene and then return to continue attacking his brother. "There were many witnesses, maybe 100 people saw what happened but the police didn't even try to interview them. I had to find the witnesses myself to identify the attacker. Why don't I become the police and wear three stars instead?" he added.
Everybody liked 'Hong Kong Boy'
Wai Cheong said that his brother was well-known in the area and everybody called him "Hong Kong Boy". "He is harmless and the people there take care of him well eventhough he does not work. His nickname came about because he was very smart as a young boy before his mental illness set in when he was in his 20s," he added. Wai Cheong said his brother, who had four other siblings, lost his legs in an accident four years ago. Wai Keong had been wandering the streets since his house was destroyed in a fire several years ago. He lived alone but Wai Cheong visited him every week.
An FMT survey in the area revealed that Wai Keong was well-liked in the area and was given food or drinks whenever he asked.
Recounting the day he found out about the incident, Wai Cheong said he had wanted to look for his brother in Pudu but was informed that he was taken in an ambulance to the hospital the night before. "At first I thought it was an accident and I went to a few hospitals but could not find him. At last I found him warded in the ICU of Hospital Kuala Lumpur. He didn't look good, he was in a coma, and was not breathing at all. The doctor said there was little hope for him," he added. Six days later on Sept 8 Wai Keong died but his family was never told of his cause of death.
Lawyer: Review the charge
DAP lawyer Keppy Wong said the police had later informed them that Wai Keong's cause of death was from inflammation of the lungs and not due to the injuries from the asault. "Given the scenario that the victim was assaulted, the police must reclassify the investigation papers and review the charge to 304 for manslaughter. We're talking about a life lost here," said Wong, who is acting for Wai Cheong. "It appears that in this case the investigation was not done properly. The confidence of the people in the police and courts must be given priority. This cannot be accepted by the public when a death had occurred," he added. Wong said that the post-mortem report should be made available so that the family could get a second opinion from other pathologists. "We would also be writing to the Attorney-General's Office," he added.
Segambut MP Lim Lip Eng and Cheras MP Tan Kok Wai were also present at the press conference. "The case must be reopened and reinvestigated," said Lim. "When there was a cat or dog abuse, there was a public outcry. Now a human life had been taken, we must voice out to the authorities to bring justice."
It was reported that in the early hours of Sept 3, Wai Keong had stopped to ask a man for a cigarette near a night club in Jalan Sungai Besi. The 34-year-old man had refused and an argument ensued, during which the man, believed to be drunk, took a cane and repeatedly assaulted Wai Keong.
Contacted later, a police spokesperson confirmed that the suspect, known only as Ah Seng, had been charged under Section 324 of the Penal Code but said that the decision to ammend the charge was with the Attorney-General's Chambers.

The Sultan of Johor Sultan Ibrahim Sultan Iskandar had said that he was offended by the statement made by me against Johor. Out of respect to the Johor Sultan, I wish to fully apologise to the Johor Sultan and his subjects, the people of Johor. I have no intention whatsoever to discredit Johor or any other state.

The Sultan had also said that politics should be left to politicians and the people should not be dragging rulers into politics. I agree with the Johor Sultan.

I feel that what I had said has been misrepresented by the BN-controlled media. I will pursue this matter in court to determine the truth of where I had made the speech, what was actually said,how and in what context it was made.

To-date except for the purported tape by TV3, there was no press report of what I spoke in Singapore or Australia. I have access to the tape of my interview with Radio Australia. I am still trying to locate the tape of what I said in Singapore which was made privately in a closed door session.

I have instructed my lawyers to immdediately file a suit in court against the BN-controlled media, beginning with Bernama.

கிள்ளானில் வசித்து வரும் சுவா தேக் சான் என்பவரின்  முகவரி வாக்களர் பட்டியலில் மாறுப்பட்டத்தை தொடர்ந்து அதிர்ச்சிக்குள்ளாகிய அந்நபர் கடந்த திங்கட்கிழமை கிள்ளான் நாடாளுமன்ற உறுப்பினர் சேவை மையத்தில் புகார் செய்துள்ளார்.

அவர் பதினைந்து வருடங்களுக்கு முன்பு, அதாவது 1996 -ஆம் ஆண்டு  கிள்ளான் பண்டாமாரன் தொகுதியில் புதிய வாக்காளராக பதிந்துக் கொண்டார். அதனை தொடர்ந்து 1999 -ஆம் ஆண்டு நடைப்பெற்ற பொதுத் தேர்தலில் வாக்களிக்க சென்ற போது, அவரின் பெயர் டூசுன் துவா, உலு லாங்காட் நாடாளுமன்றத்தில் இருப்பதாக கூறப்பட்ட போது பெரும் அதிர்ச்சிகுள்ளானதாக அவர் கூறினார்.

அவர் புதிய வாக்காளராக பதியும் போது பண்டாமாரானில் வசித்து வந்தார். அவரது அடையாள அட்டையில் கூட பண்டாமரானின் முகவரி இருக்கும் போது, எப்படி அவரின் பெயர் வேறு ஒரு தொகுதியில் பதியப் பட்டது?

அந்தச் சம்பவத்திற்கு பிறகு அவர் சில அம்னோ அதிகாரிகளின் உதவியை நாடிய போது, அவர்களின் மெத்தனப் போக்கின் காரணத்தால்,  சில குழப்பங்களுக்கும் மன உளைச்சலுக்கும் உள்ளாகிய சுவா  இவ்விவகாரத்தை அப்படியே விட்டு விட்டார்.

அன்று நாள் முதல் இன்று வரை அவர் வாக்களிக்காமல் இருப்பதாகவும், ஒரு குடிமகனாகிய அவர் தமது கடையை ஆற்ற முடியவில்லை என வருத்தம் தெரிவித்த சுவா, மேலும் அவரை அதிர்ச்சிக்குள்ளாக்கிய விசயம் மசீச நடத்திய புதிய வாக்காளர் பதிவில் பதிந்த அவரது மனைவி மற்றும் பிள்ளைகளின் பெயர்களில் எந்த மாற்றமும் இன்றி உள்ளன.

ஆனால் தாம் ஜசெக நடத்திய பதிவில் பதிந்ததால்தான்  குழப்பம் ஏற்பட்டுள்ளது. இது மசீச அரசியல் சதிதான் என அவர்  ஆணித்தரமாக ஜசெகவின் நீண்ட நாள் ஆதரவாளரான சுவா கூறினார்.

அண்மையில் இது போன்று பல புகார்களை தாம் பெற்று வருவதாக கூறிய கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ, வாக்காளராகப் பதியும் ஒருவரின் தகவல் மாறுபடுவது எப்படி என கேள்வி எழுப்பினார். கிடைக்கப் பெற்ற மற்ற சில புகார்கள்  தீர விசாரணைகளுக்கு பிறகு சாட்சியங்களோடு  மக்கள் பார்வைக்கு வெளி கொண்டுவருவோம் என்றார்.

வாக்காளர் உரிமை ஒவ்வொரு மக்களின் தனி உரிமை. அதை அத்து மீறும் இவ்வாறான செயல்கள் கண்டிக்கத்தக்கவை. இந்த விவகாரம் தொடர்பில் தேர்தல் ஆணையம் முறையான விளக்கம் அளித்ததாக வேண்டும் என கேட்டுக் கொண்ட  சார்ல்ஸ், கிள்ளானில் வாழும் மக்கள் இது போன்று பிரச்சனைகளை சந்திந்தால் தயங்காது தமது சேயை மையத்தின் (03 – 3323 2122 )  உதவியை நாடலாம் என கூறி, இவ்விவகாரத்தை துணிந்து தெரிவித்த சுவாவிற்கு தனது நன்றியையும் தெரிவித்துக் கொண்டார் அவர்.

DAP National Deputy Chairman reiterates that the Central Government should have a time-table for the abolition of the Internal Security Act, ISA, and the promulgation of new laws such as the Anti-Terrorism Act, the contents of which should be made public.

On 28,9,2011, Dr Tan spoke at the Proham (Association for The Promotion of Human Rights) meeting at a committee room in parliament. The meeting was addressed by YB Datuk Dr HJ Wan Junaidi, the Deputy Speaker, attended by Datuk Abu Zahar Ujang, Speaker of the Senate. The meeting was moderated by Datuk Dr Denison Jayasooria.

The Proham Secretary is Datuk Michael Yeoh. Besides two MPs , YB Ngeh Koo Ham, YB Dr Dzulkifly Ahmad & YB Senator Dato PK Suppiah, I was the only MP who participated. The rest were mostly journalists.

It is a good thing to see people interested in human rights. I assume that all are genuine. I hope the discussion would not be much ado about nothing.

I started to speak on himan rights in 1976. Eleven years later, I was one of them sent to the Kamunting University uder ISA, Operation Lalang, which is recorded in the book The First 60 Days.

Internatinally, there are the United Nations Declaration of Human Rights, the UN Human Rights Charter, International Court and many Human Rights NGOs. These are good things. All human beings should have human rights. But, these rights should not be abused or misused.

For example, Sadam Hussein of Iraq, Mujahidin of Afghanistan and Gaddafi of Libya imprisoned, tortured and killed many people. But, the United States (US), European Union (EU) and others have used these and the responsibility to protect against Iraq, Afghanistan and Libya, destroying the leaders and killing many innocent people. What do the US and the EU get in return?

EU military aircratfs had over 200.000 sorties over Libya with over 7,500 strikes over Gadaffi's targets. What is the actual number?. EU soldiers trained and fought side-by-side anti-Gadaffi forces. How many people have they tortured and killed?

What is powerful for good is also powerful for evil.

Nationally, successive Prime Ministers solomnly promised against the use of ISA on politicians. I met all of them except Tun Razak. The first PM Tunku Abdul Rahman stressed that the object of ISA was to deal with communists and not with politicians. The invocation of ISA to detain people who are opposed to government policies is unjustifiable.

On 3.11.1998, I met Mr H R Hickling at a Human Rights Seminar. He drafted ISA in 1960. I told him I was detained under ISA. "Is that so.?" he asked. " Did they give you the whole works?"

Now, PM Najib has claimed credit for the intention to abolish ISA. Let us have a time-table for its abolition and the promulgation of new laws such as Anti-Terrorism Act. Lets define terrorism, preventive detention, the power of the Home Minister, the Advisory Board or its equivalent. Such a law should not be abused.

General elections After electoral Reform

DAP Federal Territory of Kuala Lumpur Chairman Dr Tan Seng Giaw reiterates that the BN Government must be fair and just in dealing with electoral reform such as setting up the Parliamentary Select Committee (PSC) with fair representations and holding general elections after PSC has completed fair recommendations.



On 25.9.2011, Dr Tan spoke at the DAP FT KL Convention.



Malaysians are keeping an eye on when the Prime Minister YAB Najib will announce the date of the general elections. Pakatan Rakyat (PR) including DAP must be fully prepared for the coming elections.



Our electoral system is full of irregularities such as phantom voters. Bersih 2.0 calls for clean and fair elections, receiving widespread reactions. BN Government has acted high-handedly on Bersih 2.0 and those who demand clean elections. Now Najib wants to form PSC during the parliamentary session which begins on October 3, 2011. He speaks of electoral reform.



PSC should be based on fairness and justice, starting from representations in the committee and the electoral reform. The Government has indicated that it will take six months to complete its work. General elections should only be announced after PSC has submitted fair recommendations which are accepted by the Election Commission.




DAP KL Federal Territory Chairman Dr Tan Seng Giaw believes that there must be political commitment and action to adopt effective economic measures in order to alleviate the effects of the world economic downturn.

Global economy is entering a dangerous phase, Enrozone is in crisis and the US economy is not good. These have implications on other countries including Malaysia.





YAB Najib says he wants to increase investment and local demand as well as keeping prices of goods down. We need political commitment and action as well as integrity to do these. We hope that with improved investment, more jobs will be created.





For example, recently communications companies intended to ask 13 million users of prepaid hand phones to pay 6% service tax. This will be a factor in the rise of the cost of living. The Government negotiated with communications companies. Hitherto, this is not implemented. What will happen next?



The authorities must have integrity and professionalism in managing huge public funds such as the Employees' Provident Fund with assets of US$98.8 billion ( nearly RM300 bil). Prevent all forms of irregularities.

We must create a culture to nurture and keep talents in the country.





Most governments definitely say that they like to keep talented people and professionals. This is what people expect to hear. What is a talent? What does it mean to nurture and keep talents?



The nurturing and keeping of talents is very complex. This includes the system of education and administration. Selection and promotion of talents are not just based on the examination results, but also on other aspects such as special characteristics, the protection of controversies and young people.





We talk about brain drain in Malaysia. The Prime Minisrer YAB Datuk Seri Najib prattles about keeping talents; he hopes one day Malaysians will win the Nobel Prize. On 22.9.2011, Minister in the PM's Department Tan Sri Nor Mohamed repeated the statement that there are over 1 million Malaysian professionals overseas, 57% of them remaining in Singapore.



Those countries that manage to atract more inflow than outflow of talents have definite incentives including salaries and low taxes. Nurturing and keeping talents is a culture. Malaysia desperately needs one.





Even in government departments and universities such as the top university in this country, University of Malaya, really good people face difficulties. Cronyism still exists. Clever people tend to have controversies and departmental heads usually avoid controversies to protect themselves. These must be solved rationally.
