STOP HARASSING MP’s ;  USE POLICE RESOURCES RESPONSIBLY

I was summoned  by the Subang Jaya Police to be questioned today with regard to my involvement in raising the issue of the death in custody of Chang Chin Te  on or around 15 January in the USJ 8 police station lockup. Chang is the son of the Ketua Kampung for the Subang New Village Mr Chang Chan Man. Subang New Village is within Subang Parliament consitutency – in fact the constituency is named after the village.

The background to the case is as follows. Chang was arrested on or about January 10. He was reported dead in the lockup to the family four days later. His widow Lim Wei Ni reported seeing bruises on his face and body in the mortuary and when she took photographs was ordered by police in the mortuary and hospital staff to delete the photographs. The family was understandably suspicious about the circumstances of the death. 

Myself and YB Gobind Singh advised that a second-post mortem would be helpful and we assisted the family to present a demand to Bukit Aman to allow the second post mortem.  We were forced to go to Bukit Aman because the OCPD of Subang Jaya ACP Yahya Ramli and the Selangor CPO had refused our requests on behalf of the family to give written permission for the second post mortem.

As this was a police case, government hospitals take the unfortunate position that they will not undertake any further action without written permission in the form of a Police Form 61 signed by the police.  The request by the family was not enough. Regretably government hospitals still take this position although knowing that in death in custody cases, the police are in a position of conflict of interest and have in the past blocked requests for second post mortems such as in Kugan’s case.

I deplore today’s resource and time wasting exercise when valuable time of senior police officials are deployed in an unnecessary harassment exercise against opposition MPs taking up issues on behalf of citizens in their constituency.  I am informed that YB Gobind Singh was subjected to a similar interrogation last week on this same incident.

I call upon the IGP to ensure that the valuable resources of the police force are not misused in this fashion. OCPD’s or CPO’s  or for that matter any police officer who initiate such acts of harassment should be taken to task and disciplined.
The resources of the police force should be focused on crime fighting. A senior ASP acting on orders is wasting his time recording statements from YB Gobind and myself and conducting an investigation into alleged criminal offences conducted by us when we were in fact carrying out duties as elected representatives.

There are far more serious issues in this country that warrant investigation. A very good example would be the recent public revelation by PI Bala’s lawyer, Americk Singh Sidhu that Tan Sri Cecil Abraham, a senior lawyer, had confirmed to him that PI Bala’s second SD was done by him on the instructions of Prime Minister Najib Tun Razak.

This directly implicates the Prime Minister, his brother Nazim Tun Razak and all others involved in the commission of the offence of fabricating false evidence and suborning perjury – and even worse, the possibility that this offence was committed to keep hidden the names of those who directed Azilah and Sirul to commit the Altantuya murder. The resources of PDRM should be deployed to a reopening of this case.

New Radio Show in Malaysia Disrupted

KUALA LUMPUR, Malaysia—The founder of a new radio program aimed at airing voices challenging Malaysia’s ruling party blamed a cyberattack for disrupting her debut show.

The two-hour program, called Radio Free Malaysia, aired Monday on traditional radio airwaves and through Internet audio streaming. But the first hour of the Internet streaming audio couldn’t be heard because of a “denial-of-service” attack, in which an overwhelming number of communication requests forced the site to be shut down, said founder Clare Rewcastle Brown, a former BBC journalist. The radio distribution of the program went smoothly.

“These were well-coordinated attacks aimed at silencing us,” said Ms. Brown, who is based in London.

She accused supporters of Malaysia’s ruling coalition—the National Front—of being behind the disruption of her program.

She hosts a blog—the Sarawak Report—in Malaysia as well. It faced a similar cyberattack last week, she said. She believes that attack was sparked by National Front supporters upset by a antigovernment video posted elsewhere.

She said she hasn’t sought investigations into the incidents. The Malaysian Communications and Multimedia Commission, which regulates local media, declined to comment.

Ms. Brown launched her daily Radio Free Malaysia in the run-up to Malaysia’s general election, which must held by the end of June and is expected to be the most competitive in its history. James Chin, a fellow at Singapore’s Institute of Southeast Asian Studies doubts Radio Free Malaysia will affect the race. “A lot will depend on how many will actually tune in,” he said.

The National Front coalition, which has been in power since Malaysia gained independence from Britain in 1957, is frequently accused of heavy-handedness in its dealing with the few independent newspapers and TV stations in the Southeast Asian country.

Government-run or backed media outlets pump out the government’s positions while targeting opposition politicians, leaving little room for voices of dissent, critics say. Malaysia was ranked the 145th worst country on press freedom of 179 countries studied by Reporters Without Borders.

“There is a crisis of confidence definitely with print and certainly with TV,” said Masjaliza Hamzah, chief executive at the Center for Independent Journalism, a media advocacy group based in Kuala Lumpur.

Ms. Brown’s first show featured Malaysia’s opposition leader Anwar Ibrahim and Pan-Malaysian Islamist party’s leader Dzulkefly Ahmad.

“We will also be knocking on the doors of the National Front politicians to have them on the program,” Ms. Brown said.

Ms. Brown—who is married to Andrew Brown, the younger brother of former British Prime Minister Gordon Brown—said her London base will keep her beyond the reach of Malaysian broadcast rules, which in turn will help her in getting out the views of opposing politicians and others.

Under current regulation, local radio channels are required to inform the information and broadcasting regulator of interviews in advance. Often the regulator bars broadcasting such interviews with political opposition members.

Malaysia’s constitution gives citizens the right to freedom of speech and expression, but imposes limits. Violations can be punished by several years in prison.

Malaysia’s current prime minister, British-educated Najib Razak, has initiated reforms to loosen up rules on the news media and the tightly controlled political system as he pitches himself as a moderate keen for a more open society. Last year, he got rid of laws that required annual licensing of print publications. “Definitely what he has done so far has not yet transformed media and how Malaysians want news,” said Ms. Masjaliza, the media advocate.

Ms. Brown earlier launched a radio program called Radio Free Sarawak, a Malaysian state on the island of Borneo. She was born in Sarawak, and the program focuses on environmental challenges faced by indigenous people there due to rapid deforestation.

Radio is popular in Malaysia. Malaysians topped the radio listener list in the Asian-Pacific region, tuning in for an average of 21 hours and 34 minutes a week in 2011, according to a survey by market researcher Nielson.

“My target audience is the rural people, who need an alternative medium to know what’s happening,” Ms. Brown said.

Radio Free Malaysia can be accessed via http://radiofreemalaysia.org and broadcast daily on 1359kHz AM/MW from 9.00pm to 11.00pm.

Parti Keadilan ingin menyatakan di sini pendirian menolak tawaran masa media sepuluh minit yang diberikan kepada kami oleh RTM.

Tawaran ini adalah satu sandiwara hodoh pihak yang jahilkan peranan media dalam demokrasi. Peranan media dalam sistem demokrasi ialah untuk memberi liputan dan laporan berita yang objektif, adil dan saksama. Adalah tidak wajar media diperalatkan sebagai mesin propaganda untuk memaksakan pandangan UMNO ke atas rakyat.

Tawaran masa media 10 minit ini adalah suatu penghinaan terhadap kepintaran rakyat.

MEDIA STATEMENT:Malaysians leaning to Pakatan Rakyat, desperation forcing Umno to rely on dirty tricks

With the 13th General Election almost upon us, PKR would like to forewarn the rakyat that this will be the dirtiest election in the country’s history. There are high levels of fear within Barisan Nasional’s (BN) leadership, despite the false confidence it portrays to the media.

More than the manipulation and control of information via mainstream media, government machinery is being abused to ensure a BN victory.

Taxpayers’ money is being routed to cloud the rakyat from the reality that the country’s competitiveness has slipped and economic achievements imbalanced. Umno leaders know their time is up. Despite their unrelenting arrogance, we are informed that their own intelligence reports tell them they are about to lose the election. Which is why the Prime Minister Dato’ Seri Najib Razak is continuously delaying Parliament dissolution. Umno is actually struck by indecision and a crisis of confidence.

This is underlined by its extreme actions. The two prong tactic by Umno now is to scare the Malays and hiring mercenaries to use blogs to create and distribute doctored videos alleging sexual misconduct by PKR leaders. In the first prong they seed fear in the Malay community, telling that their future is doomed under Pakatan Rakyat. The truth remains that Umno is the real character gambling the Malay interest.

In the second tactic of alleging sexual misconduct, we are reliably informed that besides the present doctored video attempting to besmirch Dato’ Seri Anwar Ibrahim’s reputation, other sexual videos supposedly with other PKR leaders in them will be distributed soon. These videos are the result of digital image manipulation involving the coupling of separate scenes to provide the impression that our leaders are participating in sexual misconduct.

PKR would like to tell the Malaysian people that the instances of such insidious acts against us are expected and our leaders are capable of weathering them, for the righteous are often tested. NabiYusuf AS, Maryam AS dan Aishah RA faced too in their time such sexual allegations.
If these noble souls have been tested as such, surely humble men and women like ourselves will not be exempt from challenges and accusations. The experience will only increase our fortitude in this struggle and spurs us forward with more determination. We know the people see these doctored videos as desperate, despicable and over the top political tactics of Umno.

We are certain the Malaysian people will stand by the truth and won’t be intimidated or fooled by Umno’s morally reprehensible deceptions. They will choose wisely and build a better future for the country by voting Pakatan Rakyat.

KENYATAAN MEDIA: Taktik kotor Umno kerana rakyat semakin memilih Pakatan Rakyat

Menjelang pilihanraya umum ke 13 ini, PKR ingin memaklumkan rakyat bahawa mereka hendaklah bersedia menghadapi pilihanraya umum yang paling kotor dalam sejarah negara. Di sebalik keyakinan yang cuba ditonjolkan pemimpin UMNO melalui media arus perdana, wujud kekhuatiran yang ketara di kalangan pemimpin tertinggi BN.

Selain dari manipulasi dan pengawalan maklumat melalui media arus perdana, jentera kerajaan disalahgunakan untuk memenangkan BN. Duit cukai rakyat digunakan untuk melalikan rakyat dari hakikat bahawa daya saing negara semakin merosot dan pencapaian ekonomi negara tidak seimbang. Kepimpinan tertinggi UMNO tahu masa depan mereka telah pudar. Walau pun kepimpinan UMNO cuba memberi gambaran mereka yakin akan menang, kita sedia maklum berbagai maklumat perisikan yang mereka terima telah memberi penilaian bahawa BN akan tewas pada pilihanraya umum ke 13 yang menjelang tiba. Inilah sebabnya Perdana Menteri Dato' Seri Najib Razak terpaksa berterusan menangguh pembubaran Parlimen. UMNO sebenarnya sedang mengalami kegusaran dan krisis keyakinan.

Dalam kegusaran ini, UMNO mula mengambil tindakan-tindakan yang terdesak. Dua teras utama taktik yang diambil UMNO hari ini ialah menakut-nakutkan orang Melayu dan menggunakan askar-askar upahan di ruang-ruang blog untuk mereka-reka dan menyebarkan video-video palsu yang kononnya memaparkan salahlaku seks pemimpin-pemimpin PKR. Taktik pertama melibatkan menakut-nakutkan masyarakat Melayu bahawa masa depan mereka akan tergadai jika Pakatan Rakyat memerintah, walau pun UMNO lah sebenarnya yang menggadaikan kepentingan orang Melayu selama ini.

Taktik kedua ialah menggunakan dakwaan salahlaku seks. Selain dari video palsu yang cuba mencemarkan nama baik Dato Seri Anwar Ibrahim, kita mendapat maklumat dari sumber-sumber yang boleh dipercayai bahawa beberapa video palsu seks beberapa orang pemimpin lain PKR akan diterbitkan. Video-video ini merupakan manipulasi imej digital yang melibatkan pencantuman babak-babak yang tidak berkaitan untuk memberi gambaran pemimpin-pemimpin berkenaan terbabit dalam salahlaku seks.

PKR ingin mengingatkan rakyat Malaysia bahawa sudah menjadi lumrah perjuangan bahawa mereka yang berada di barisan kebenaran akan diuji dengan sengit. Nabi Yusuf AS, Maryam AS dan Aishah RA semuanya diuji dengan dakwaan seksual. Jika insan-insan mulia ini diuji sebegini rupa, sudah tentulah insan biasa seperti kami tidak akan terlepas dari dugaan dan fitnah. Fitnah dan tuduhan-tuduhan seksual palsu yang bertubi-tubi ini hanya meyakinkan kami akan ketulusan perjuangan kami. Ia hanya mengukuhkan keazaman kami untuk terus mara ke hadapan. Dan kami yakin video-video palsu ini akan dilihat rakyat sebagai taktik politik UMNO yang terdesak, jijik dan keterlaluan.

Kami yakin rakyat Malaysia akan berdiri teguh dengan kebenaran dan tidak akan mudah diugut atau diperdayakan oleh tipu helah serta muslihat kotor UMNO. Mereka akan membuat pilihan yang bijak dan membina masa depan negara yang lebih cerah dengan memilih Pakatan Rakyat.

Najib perlu segera bubar parlimen, elak kekeliruan- Prof Aziz Bari

KUALA LUMPUR 26 Mac: Perdana Menteri, Datuk Seri Najib Razak perlu membubarkan parlimen segera bagi mengelakkan lebih banyak kekeliruan khasnya di kalangan rakyat, kata Profesor Dr Abdul Aziz Bari.
Ini kerana Dewan Undangan Negeri Sembilan kini menjadi DUN pertama terbubar secara automatik, sedangkan parlimen masih belum dibubarkan.
Keadaan itu, kata Aziz, menyebabkan Menteri Besar, Datuk Seri Mohamad Hasan  'terkial-kial' berhadapan situasi seperti itu.
Semalam, Mohamad berkata, DUN Negeri Sembilan akan terbubar secara automatik pada Khamis 28 Mac ini, sekiranya tiada pembubaran DUN berlaku pada Rabu, 27 Mac.
Mohamad berkata, kerajaan negeri menggunapakai Akta Interpretasi 1984 dan 1967 bagi menentukan tarikh DUN dibubar secara automatik, di mana DUN di negeri itu kali pertama bersidang pada 25 Mac 2008.
Bagaimanapun menurut Aziz, beliau hairan dengan keputusan itu, sedangkan perlembagaan jelas menyebut DUN akan terbubar sendirinya setelah genap tempoh lima tahun bersidang.
"Saya berasa aneh tentang perlunya MB Negeri Sembilan merujuk kepada Akta Tafsiran 1967. Rujukan ini hanya perlu sekiranya ada kesamaran.
"Tempoh lima tahun itu jelas disebut oleh perlembagaan, dikira dari sidang pertama dewan selepas PRU. Apa yang tak jelas disini?
"Kita kena ingat perlembagaan mengatasi undang-undang lain; termasuk undang-undang bertulis bernama Akta Tafsiran 1967 itu.
"Najib kena bubar cepat. Sebab kalau tidak akan keliru; dan Mohamad Hasan ini sudah terkial-kial. Kenapa Najib biarkan MB dia terkial-kial dan malu begitu?," soal bekas Pensyarah
Undang-Undang Universiti Islam Antarabangsa itu lagi.

Mengulas mengenai penubuhan kerajaan sementara di Negeri Sembilan, Aziz berkata Yam Tuan Besar boleh melantik Mohamad Hasan semula sebagai menteri besar.
Katanya, meskipun ia tidak dijelaskan dalam Undang-Undang Tubuh Kerajaan Negeri,  istana perlu menunjukkan keprihatinan terhadap perkara itu bagi memenuhi amalan tersebut.
"Kuasa itu ditentukan oleh Yamtuan; atau kalau di peringkat persekutuan Yang Di Pertuan Agong. Atau Sultan atau Yang di Pertua Negeri kalau di negeri lain.
"Yamtuan – atau Agong – perlu lantik kerajaan untuk memberi nasihat kepada baginda. Dalam bahasa biasa menjalankan rutin pentadbiran.
"Ketua negeri atau ketua negara mesti sentiasa ada kerajaan untuk memberi nasihat. Ini tidak boleh dilambat-lambatkan," katanya ketika dihubungi.
Secara prinsip, katanya, sesiapa sahaja boleh dilantik mengetuai kerajaan sementara ini.  Ia katanya, menjadi amalan biasa di negara yang mengamalkan sistem kerajaan berpelembagaan atau westminster lain.
Malah kata Aziz, tanpa penubuhan kerajaan sementara pun, pentadbiran negara atau negeri masih boleh dijalankan seperti biasa oleh penjawat awam sedia ada.
"Saya fikir pentadbiran negara boleh berjalan macam biasa. Ketua Setiausaha Negara kan ada, Panglima Angkatan Tentera dan Ketua Polis Negara pun ada. Apa yang susah sangat?," soalnya.
Dengan kata lain, katanya, perdana menteri atau menteri besar boleh mengundurkan diri jika mandat yang diberi kepada mereka berakhir. Ini sekaligus mengelakkan sebarang salahgunakuasa,  khasnya membabitkan jentera kerajaan ketika pilihan raya.

PETALING JAYA 26 MAC: Penyebaran video seks fitnah melibatkan pimpinan KEADILAN taktik terakhir Umno BN berdepan Pakatan Rakyat dalam pilihan raya akan datang.
Setiausaha Agung KEADILAN, Datuk Saifuddin Nasution Ismail berkata, taktik kotor itu terpaksa digunakan kerana Umno BN kehabisan 'umpan' untuk mengalahkan kekuatan Pakatan Rakyat.

"Umno BN takkan pernah berhenti (sebar fitnah). Mereka tidak mampu lawan dari segi dasar, tawaran dan rekod pemerintahan. Mereka hanya boleh bergerak di atas penguasaan media perdana untuk membina persepsi hodoh rakyat terhadap pemimpin KEADILAN dengan menerbit video jijik dan tidak bermaruah.

"Ajak debat tak nak, kita (Pakatan) buat manifesto, dia (Umno BN) tak buat. Kita lancar manifesto, dia lancar video," katanya pada sidang media di Ibu Pejabat KEADILAN, di sini hari ini.
Saifuddin mengulas pendedahan terbaru video lucah yang didakwa melibatkan pimpinan KEADILAN yang ditonton beliau bersama beberapa pemimpin parti.
Menurutnya, video itu dipertonton kepada beliau oleh ejen Umno tiga hari lalu dalam kereta yang dipandu sekitar Kuala Lumpur.
"Ada satu dua lagi video yang akan diberikan kepada kita. Setakat ini video dan gambar lucah melibatkan Ketua Umum KEADILAN, Datuk Seri Anwar Ibrahim dan anaknya, Ahli Parlimen Lembah Pantai, Nurul Izzah Anwar.
"Maklumat kita terima dari pelbagai. Berdasarkan pratonton, kita juga dapat maklumat ada video melibatkan Menteri Besar Selangor yang meragukan dalam pembikinan. Ini melibatkan sumber-sumber penting dalam Umno BN," kata Saifuddin.
"Ejen tersebut beritahu saya, ada dua lagi (video pemimpin KEADILAN) yang akan diberi kita tengok. Ejen-ejen itu saya tidak pernah kenali, tetapi mereka seperti mengetahui banyak tentang video-video aksi dalam pembikinan," kata Ahli Parlimen Machang itu.
Menurut Saifuddin lagi, video yang ditontonnya dalam kereta tersebut tidak memaparkan aksi lucah, tetapi hanya memberi gambaran aksi SX 18 dan imej gambar berkenaan dikaburkan.
"Mereka tidak berniat untuk menayangkan video yang terang. Mereka mahu tunjuk asalkan ia nampak seakan-akan watak sebenar, itu sudah cukup buat mereka.
"Mereka mahu kita terjebak dengan taktik tersebut, sebab itu kita maklumkan kepada rakyat tentang hal itu," katanya. – NS

PKR juga tolak tawaran siaran 10 minit RTM

PKR hari ini menolak tawaran Radio Televisyen Malaysia kepada parti pembangkang untuk menyiarkan manifesto mereka selama 10 minit di saluran tersebut.

Pengarah komunikasi PKR Nik Nazmi Nik Ahmad berkata parti tersebut menolak tawaran berkenaan yang dilihat sebagai "muslihat politik".

"Tawaran siaran 10 minit itu satu penghinaan kepada pemikiran rakyat," katanya dalam satu sidang media di ibu pejabat PKR hari ini.

"Menteri penerangan (Datuk Seri) Rais Yatim menggunakan tawaran ini untuk membuktikan (kerajaan memberi) akses bebas kepada media, tapi sebenarnya tidak," katanya.
