Kerajaan negeri bercadang untuk menubuhkan satu jawatankuasa siasatan khas ke atas stesen parkir kereta bertingkat bawah Bukit Bendera(Penang Hill) yang dipengerusikan oleh En Shahawai bin Awang, bekas Pengarah JKR Pulau Pinang dan dianggotai oleh President Persatuan Arkitek Malaysia Pulau Pinang Ar Lawrence Lim Hua Kwang dan bekas Presiden Institute of Engineers Malaysia(IEM) Pulau Pinang Ir Lim Kok Khong.

Mengikut kenyataan Pengerusi PDC Consultancy Sdn Bhd yang juga Pengurus Besar Penang Development Corporation(PDC) Dato Rosli Jaafar,

"Projek sebanyak RM5 juta dibiayai oleh Kerajaan Persekutuan. Projek ini telah diluluskan oleh EXCO pada 2007 kepada PDC sebagai agensi pelaksana yang seterusnya diberikan kepada PDC Consultancy Sdn Bhd. Oleh kerana ia melibatkan PDC Consultancy Sdn Bhd pada 2007, Pengerusi PDC yang baru selepas Mac 2008 tidak diminta untuk memberikan kelulusan atau dimaklumkan tentang projek ini.

Memang wujud kelemahan isu rekabentuk yang tidak memenuhi kehendak piawaian yang boleh menjejaskan keselesaaan pengguna Pihak PDC Consultancy Sdn Bhd telah sebaik mungkin memperbaiki kelemahan rekabentuk khususnya mengurangkan kecuraman 'ramp' agar lebih landai dan boleh digunakan oleh semua jenis kenderaan.

Walaubagaimanapun, PDC Consultancy Sdn Bhd sebagai jurutera perunding sememangnya bertanggungjawab atas penyediaan rekabentuk dan pelaksanaan projek ini. Sebarang kesilapan dan kelemahan yang berlaku, sudah tentunya pihak pegawai PDC Consultancy Sdn Bhd bertanggungjawab dan bersedia diambil tindakan yang sewajarnya.

Buat masa sekarang, laporan dan langkah pembetulan kini dijalankan demi memastikan rekabentuk sejumlah 6 hentian bas dan 112 tempat letak kereta dapat beroperasi di atas lot yang seluas 0.62 ekar ini. PDC akan mematuhi arahan YAB Ketua Menteri agar sebelum dibuka, keselamatan awam dan peraturan MPPP mestilah dipatuhi."

Dato Rosli telahpun memohon maaf bagi pihak PDC Consultancy Sdn Bhd atas segala kesulitan yang timbul dan akan secepat mungkin menyelesaikan masalah ini. Walaupun begitu, demi menegakkan prinsip akauntabiliti dan ketelusan, satu jawatankuasa siasatan bebas harus ditubuhkan kerana kerajaan negeri Pakatan Rakyat tidak ada apa-apa untuk disembunyikan.

Jawatankuasa siasatan bebas ini harus diadakan agar sesiapa yang bertanggunjgawab atas kelemahan yang timbul, boleh diambil tindakan dan cara penyelesaian mengatasinya mendapat pandangan bebas ketiga. Penubuhan jawatankuasa siasatan dan terma rujukan siasatan ini akan diputuskan dalam mesyuarat EXCO hari ini.

州政府计划成立一支由前任槟州公共工程局主任沙哈瓦伊为首的调别调查委员会,以调查升旗山脚下多层停车场,该委员会成员包括大马绘测师公会槟州分会长的林华光和前任槟州工程师协会的主席林国康。

根据槟州发展机构谘询有限公司主席兼槟州发展机构总经理拿督罗斯里的声明:

"这项耗资500万令吉的工程由联邦政府拨款兴建,行政议会于2007年批准交由槟州发展机构作为执行单位,较后交给槟州发展机构谘询有限公司,由于已在2007年涉及槟州发展机构谘询有限公司,新任的槟州发展机构主席于2008年3月后就职后,并没被告知有关这项工程的资料和要求给予批准。

这项工程确实存在设计缺陷,不符合水准,也会影响用户。槟州发展机构谘询有限公司已尽可能修补设计上的问题,特别是降低有关斜陡度,以让各类交通工具使用。

无论如何,作为工程顾问的槟州发展机构谘询有限公司应当对这项工程的设计和执行负责,任何已经发生的错误和缺陷,槟州发展机构谘询有限公司肯定将负责,并准备采取适合的行动。

当局目前正进行修补和调查报告,以确定这占地0.62依格,能容纳6辆巴士和112个停车位的停车场得以使用。在停车场开放前,槟州发展机构将遵循槟州首席部长的指示,确保民众安全和遵守槟岛市政局的规则。"

拿督罗斯里已代表槟州发展机构谘询有限公司,为一切引起的不便表示道歉,并将尽快解决有关问题。虽然如此,为了维护问责制和透明度原则,槟州政府将成立一支独立调查委员会,因为民联州政府没有什么需要隐瞒民众。

独立调查委员会有必要成立,以采取行动对付需要为该错误负责的一方,并能从独立第三者的意见中寻找一个经济方案,有关调查委员会的成立和调查范围将在今天的行政议会中决定。

Debate with Mat Sabu, not prosecute him!

We, the undersigned civil society organisations, collectively register our utter disgust over the prosecution of PAS deputy president Mohamad Sabu under Section 505 of the Penal Code with uttering statements tantamount to public mischief. He was even briefly arrested last night.

 Charging Sabu goes against Prime Minister Datuk Seri Najib Tun Razak’s pledge to promote openness and democracy on Malaysia Day.

 It raises questions over the sincerity of PM Najib in announcing a series of reforms  including amendment of the Printing Presses and Publications Act (PPPA), whether he has full control on the police or both.

We urge the government to immediately drop the politically-motivated charge of Sabu and stop intimidating dissidents who oppose and challenge official history and ideology.

 We urge the PM and DPM, instead of using government machinery to criminalize Sabu, to take up the challenge posed by him by having a no-holds-barred TV debate on the Bukit Kepong issue.

 Likewise, politicians, retired police and military personnel as well as groups like Perkasa can debate with Sabu or expose the flaws of his views in media or in forums. They should respect Sabu’s right to have opinions from theirs.

 Resorting to the state power to silence an opponent’s view is an act of cowardice. It shows only insecurity and no confidence to win a debate with facts and reason.

 Such suppression of freedom is in fact an insult to independence of this country. For with independence, Malaysians should enjoy human rights and freedoms, unlike subjects of colonies or one-party states.

Is it a Crime to have a Different Point of View from Barisan Nasional / UMNO?

The criminal defamation charge against PAS deputy president Mohamad Sabu at the Butterworth Sessions Court this morning was trumped up to serve the political aims of the Barisan Nasional.

By challenging the official account of the 1950 Bukit Kepong incident at a ceramah in Tasek Gelugor on Aug 21, Mat Sabu has opened discussions into a section of our history that needs to be reviewed.

Just how proposing an alternative view of history can lead to a criminal charge is anyone's guess.

The writing of history should be an academic one. History should be as objective as possible with little or no intervention from any party that wants to tweak it to suit their needs and goals.

It is not the job of the government to write history – that should be left in the hands of the academics, historians and the public through agreed and established processes.

If Barisan Nasional feels it has the right to determine what our history should be, then we should close down the history departments in our universities.

The job of the government is to make sure we, as a society, learn from history and move forward. The initiative to explore alternative perspectives on history should not be stifled due to self-serving interests.

Mat Sabu's only crime in this case is that he is a leading member of PAS which is increasingly perceived as an alternative to UMNO.

The fact that this charge, which challenges the freedom of speech guaranteed in our Constitution, came just days after the Prime Minister announced a string of "reforms" involving restrictive laws says a lot to the commitment, sincerity and spirit in which the announcement on the eve of Malaysia Day was made.

Foreigners Can Vote in Malaysia !‏

Clear proofs that non citizens have been registered as voters. Deputy Prime Minister and the Election Commission must no longer be in denial mode.

I am disappointed that Deputy Prime Minister, Tan Sri Muhyiddin Yassin and the Election Commission continue to deny that there are foreigners who are registered as voters in this country.

The following and foreigners are registered in my constituency of Beruas ;

However, a check with the National Registration Department shows that there are no person with such Mykad numbers. The likelihood is that these foreigners have been issued unauthorised Mykads and they have manage to register themselves as voters. On polling day they will be allowed to vote using their Mykads because nobody will know that their Mykads are fake ones. As their names appear in the Voters' list, they will be allowed to vote.

It is a well known fact that many foreigners have been able to obtain Mykads with ease. The complaints I receive is that it will be easier for foreigners to obtain the Malaysian citizenship if they are Muslims.

It has been so difficult for many Malaysian born residents to obtain citizenship for various reasons. Just like the case of Chan Ming Ying, aged 31 who was born in Malaysia and has been living in Malaysia whole of his life. He studied in Sekolah Rendah (c) in Sg Batu and Sekolah Menengah Pantai Remis both in Perak and subsequently in the Johor Bahru Polytechnic. His only 'sin' is that his Chinese parents adopted him without going through the proper legal procedure. His adoptive Chinese parents have put their names into his birth certificate as the natural parents which is quite a common practice. His case was detected because his natural father was a Chinese and mother an Indian. His natural parents can no longer be traced. So, his skin is a little darker and therefore, the NRD refused to recognize him as a citizen. He is now a state less person holding a green card which allow him to stay in Malaysia only temporarily.

I call on the Home Minister and the Election Commission to clarify and rectify the above said matters.
