Prime Minister Najib Tun Razak has been urged to step in to resolve the issue of Pahang government's refusal to pay a logging company RM70 million awarded by the Kuantan High Court.
DAP's Segambut MP Lim Lip Eng said that the federal government could readily provide a grant or a friendly loan (without interests) to the Pahang government if the latter found it difficult to come up with the money. Said Lim: "I think it's about time the prime minister intervened… He is a Member of Parliament from Pahang. This is his own state and he shouldn't ignore this." Lim also said that the Pahang government has misused and abused Order 73 under the Rules of the High Court 1980, which states that no judgment or orders can be enforced against the government. "We believe that the state government is using this law to shield it from paying the judgment sum. "Legally, the state government may be protected from enforcement actions under this section. But ethically, in the eyes of public, local and foreign investors… the state has failed to honour its business contractual terms and the court of law." Lim said that never in Malaysian history has the government refused to pay an amount when it has been decided by a court.
"In Penang, (Chief Minister) Lim Guan Eng had always paid what is being awarded by the court even though this was something done by the previous Barisan Nasional state government." "Why? Because this is what he (Guan Eng) preaches: a good government, transparency and abiding by the law. That's why Penang has seen a huge jump in foreign investments," said Lim.
Breaching logging contract
Ten men, directors and shareholders of a logging firm Seruan Gemilang Makmur Sdn Bhd, are now on a hunger strike relay to compel the Pahang government to abide by a court ruling to pay their company some RM70 million. The company had in 2002 sued the state for breaching a logging contract in which Seruan Gemilang claimed it was issued a permit to clear 8,000 acres of forest in Pekan, said to be owned by Pahang Umno. However, it was later discovered that the land was owned by the state government and not Pahang Umno, eventually forcing the company to cease operations until the matter was resolved. In May 2007, the Kuantan High Court ruled in the company's favour and ordered the Pahang government to pay them more than RM37 million plus interest of 8% per annum. The total comes close to RM70 million. The men started the strike in front of a temple in Segambut on Sept 8, rotating in pairs. Two have since been replaced after they collapsed last week and earlier this week.
'No respect for law'
PAS' Shah Alam MP Khalid Samad and PKR's Selayang MP William Leong visited the hunger strike protesters this morning. "The Pahang state has no respect for the law. The court has ruled, don't mislead the public. For the state government to completely disregard the court… it is either bankrupt or is just a bunch of gangsters," he said. "The BN has been in power for too long… getting away with murder in the case of Altantuya Sharriibuu, and it has already corrupted the whole judicial process with Anwar Ibrahim's trial," said Khalid. "How can you have a BN state government with such attitude? This is typical of Umno and BN attitude," he said. It is understood that the hunger strike would last until tonight as the protesters are planning on continuing it near the Balok beach in Kuantan.
Seruan Gemilang manager Lee Sin said this decision was made because there are more than 100 investors, staff, and former workers who would participate in the strike in Pahang. "Besides the 10, we also had other workers who lost their income when the Pahang government stopped the logging work. Eventhough some of them have passed away, we hope to help their family if we can get back the payment," he said. The group is also hoping to seek an audience with the Pahang Sultan to raise the matter.

The Next 6 Months Will Determine Whether The Boldest Political Experiment Of Establishing A People-centric Government Will Prevail Or Perish From Penang?

The next 6 months will determine whether the boldest political experiment in the 2008 general elections of establishing a people-centric government will prevail or perish from Penang. Over the last 3 and a half years, there is a not only a cleaner, greener and safer Penang but also witnessed a change of mindset and renewed confidence.

Penangites are more confident and hence more optimistic about the future because they can rely on a people-centric government that listens to them, do the people's work and gives hope for a better future. Similarly there is a recognition that we will be rewarded for hard work, being honest and continuously pursue excellence. There is no substitute for performance, productivity and proficiency.

However the greatest change in mindset is brought about by the emphasis of the Pakatan Rakyat people-centric government on upholding rule of law. That one does not need to go through middle-men or know third parties to get any transaction done in Penang. We need only to know the rules and the law.

By ensuring there is not only certainty but also clarity, we can enjoy prosperity together. The PR state government has worked hard to regain the people's trust and confidence in the state government. To overcome public distrust of the state government as an institution that does not help but harm the people, PR has terminated the politics of patronage, cronyism and corruption.

Let us inspire hope by stressing on performance not privilege, expertise not entitlement and integrity not corruption. Let us be bonded by our common aspirations for justice, freedom, truth, democracy and social welfare for the weak and poor.

Only an economy free from corruption can we ensure that the people prosper and benefit. Let us embrace a future free from fear and cronyism. Let us embrace the future by embracing every Malay, Indian, Chinese, Kadazan and Iban, as Malaysian brothers and sisters, Malaysian sons and daughters.

Enam bulan yang akan datang akan menentukan sama ada eksperimen politik dalam pilihanraya umum ke-12 pada tahun 2008 yang telah mewujudkan sebuah kerajaan berjiwa rakyat akan semakin menyerlah atau melesap di Pulau Pinang. Selama tiga setengah tahun yang lepas, negeri Pulau Pinang bukan sahaja telah menjadi lebih bersih, hijau dan selamat, malah juga telah menampakkan perubahan dari segi pemikiran dan keyakinan.

Warga Pulau Pinang semakin yakin dan optimis terhadap masa depan kerana mereka boleh bergantung kepada kerajaan berjiwa rakyat yang mendengar kata rakyat, melakukan kerja untuk rakyat dan memberi harapan untuk masa depan yang lebih cerah. Sekarang juga sudah terhasil satu pengiktirafan bahawa ganjaran akan diperoleh berdasarkan daya upaya, kejujuran dan usaha untuk mengejar kecemerlangan. Sesungguhnya tiada pengganti bagi prestasi, produktiviti dan kecekapan.

Walau bagaimanapun, perubahan yang paling besar dalam pemikiran telah berlaku ekoran daripada dasar kerajaan berjiwa rakyat Pakatan Rakyat yang menegakkan kedaulatan undang-undang. Di Pulau Pinang, dasar ketelusan yang dijalankan oleh Kerajaan Negeri bermakna bahawa sebarang urus niaga tidak lagi memerlukan orang dalam atau orang tengah. Yang diperlukan hanya peraturan dan undang-undang.

Dengan kerajaan yang mementingkan kepastian dan kejelasan dalam halatuju pentadbiran, kita dapat menikmati kemakmuran bersama-sama. Kerajaan Negeri Pakatan Rakyat telah bekerja keras untuk memulih kembali kepercayaan dan keyakinan rakyat terhadap kerajaan negeri. Untuk mengatasi ketidakpercayaan awam terhadap institusi kerajaan negeri, Pakatan Rakyat telah menghapuskan politik kuasa naungan, kronisme dan rasuah.
Marilah kita mencari inspirasi dengan menekankan prestasi dan bukan keistimewaan, kepakaran dan bukan hak, serta integriti dan bukan rasuah. Marilah kita bersepakat dalam semangat setiakawan untuk mencapai aspirasi bersama untuk keadilan, kebenaran, kebebasan, demokrasi dan kebajikan sosial untuk rakan-rakan kita yang lebih lemah dan miskin.

Hanya dengan ekonomi yang bebas daripada rasuah boleh kita memastikan bahawa rakyat akan makmur dan menerima manfaat. Marilah kita mengazamkan masa depan yang bebas daripada ketakutan dan kronisme. Marilah kita mencita-citakan masa depan di mana semua lapisan masyarakat dan kaum, sama ada Melayu, India, Cina, Kadazan atau Iban, akan dianggap sebagai saudara senegara tanpa sebarang diskriminasi.

Untuk menandakan Hari Malaysia di Pulau Pinang, Perbadanan Bukit Bendera akan menawarkan perjalanan keretapi percuma untuk sehari pada 16 September 2011 untuk semua warga Malaysia dari Sabah dan Sarawak.
