It's official: Notices have been put up at The Mall to indicate a change in ownership.

SEVERAL retailers at The Mall shopping complex near the Putra World Trade Centre in Kuala Lumpur have been issued eviction notices by the new management.
Spokesman for the retailers Melissa Tan said the new owners, Sunway Management Sdn Bhd, wanted them to sign a fresh tenancy agreement as they did not recognise the existing one with the previous owner. She said several eviction letters and ultimatums had put the tenants under tremendous mental anguish. "Now there are two management teams in The Mall with their own set of rules. Both management teams are invoicing the tenants. Sunway and Metroplex Holdings Sdn Bhd both have their own set of security guards, too," she said. She added that tenants had registered a 70% drop in sales since the takeover due to "uncertainties".
Ad hoc tenants committee chairman Datuk Ismail Samsudin, who is a jewellery retailer, said the tenants did not know who the rightful owner was. "They fear that if they don't comply with the demands of the new management, water and electricity supply would be cut and they wouild be forcefully evicted," he said.
The briefing was attended by Segambut MP Lim Lip Eng and Lembah Pantai MP Nurul Izzah.
"We have called the parliamentarians to help advice tenants on the action to take to safeguard our interest," Tan said. Lim and Nurul advised the tenants to speak in one voice and engage legal advice. Lim, a lawyer, told the tenants that they could still continue to pay their bills but the money could be left in a stakeholder account until the matter was sorted out.
Tan said the problem started when the previous owner turned to the court to cancel the auction sale claiming irregularities.
But Sunway Group legal counsel David Lingam of David & Co said the KL High Court had dismissed Metroplex's summons and deemed OSK Trustees Berhad, the trustees for Sunway Real Estate Investment Trust as the rightful owner. "By virtue of the takeover, the tenants under the previous owner are considered trespassers," Lingam said, adding the court on compassionate grounds have given them some time to move out. Under the law, all previous tenancy agreements become null and void when a property is successfully auctioned off. "In this case, they are trespassers and they have to abide by the law and sign a new agreement with Sunway or they can be legally evicted," Lingam said. Asked why Sunway being the rightful owner has not taken action to exert its ownership by evicting the previous management and its security guards from the premises, the lawyer said Sunway did not practice high-handed tactics.
It is also learnt that KL City Hall has revoked the operating licence of Legend Hotel, which together with The Mall and an office block form Putra Palace. The property was sold to OSK Trustee Bhd for RM513.95mil in March, about three years after it was first put up for auction. Commerce International Merchant Bankers Bhd put the property up for auction to recover loans given to property owner Metroplex. Lim Siew Kim, the daughter of the late Tan Sri Lim Goh Tong, founder of the gaming firm Genting Resorts, holds a majority stake in Metroplex.

ADUN DAP YB Ong Boon Piow mengkritik MBI secara tidak mengumumkan penukaran haluan Persiaran Greentown 2 kepada jalan sehala minggu lalu,adalah tidak bertanggungjawab. Kerana tindakan ini telah mengakibatkan kebanyakan pemandu kenderaan keliru atas perkara ini, dan pihak PDRM telah mengambil kesempatan untuk mengeluarkan saman semasa pemandu dalam keadaan keliru.

Beliau menyatakan bahawa selepas jalan ini diubah haluan, pemandu kenderaan ke jalan ini terpaksa mengambil jalan Persiaran Greentown 1 (yang telah penuh sesak terutamanya di bahagian Maybank) atau Jalan Dato Seri Ahmad Said untuk sampai ke Kedai di Persiaran Greentown 2. Secara tidak langsung, ini adalah membazir masa dan minyak pemandu.

Untuk menyelesaikan masalah ini beliau mencadangkan agar Persiaran Tugu menjadi jalan dua hala semula. Dan ini akan juga akan membantu meningkatkan aktiviti untuk peniaga di Persiaran Greentown 2.

他今日与行动党霹雳州公共投诉局主任郑福基,州委谢保恒,行动党州执行秘书萧利华,改朝换代小组主任黄云龙,以及党要们当场了解情况后。表示市政厅去年计划装修Persiaran Tugu 马来小食档的设备时,以决定要把此两条路改为单行道。但是至今市政厅没有对外公布此事,就在上星期就开始安装路牌。

他指这样的道路规划,导致要前往Persiaran Greentown 2的交通使用者必需绕大圈来到达目的地。他建议该局应该取消Persiaran Tugu单行道的决定,而非为了晚间的方便晚上小食档的食客,让大部分人麻烦。不然这只是浪费车主的时间和燃油,甚至白白中冤枉交通传票。

Majlis Perundingan Upah Kebangsaan (NWCC) 2011 telah menggantikan Rang undang-undang  Akta Majlis Penetapan Upah 1947.

a)      Gaji minimum bolah dilaksanakan tanpa NWCC

Rang Undang-undang yang dicadangkan mewujudkan Majlis Perundingan Upah untuk menjalankan kajian dan membuat syor kepada kerajaan mengenai gaji minimum. Badan yang dicadangkan akan perundingan dalam sifat tetapi keputusannya tidak mengikut Kerajaan.

Semua cadangan Majlis mesti melalui Menteri yang diberi kuasa untuk membuat keputusan muktamad. Selain itu, Ahli-Ahli Majlis akan dilantik oleh Menteri.

Menteri mempunyai kuasa yang mutlak dan berkuasa untuk membuat keputusan mengenai gaji minima. Menteri akan melantik Ahli Majlis untuk membuat keputusan yang terakhir dan mengawal proses untuk menentukkan gaji minimum.

Oleh itu, Menteri bolah menentukkan gaji minima dengan bekerjasama daripada pihak Jawatankuasa Teknikal dalam Kementerian. Selain itu, penubuhan sebuah Majlis Perundingan Gaji Kebangsaan adalah berlebihan dan membazirkan dana wang dan ia memperkenalkan satu lapisan yang birokrasi dalam penentuan gaji.

b)   Definisi gaji minima-hilang!

Rang undang-undang tidak menentukkan rangka kerja gaji minima untuk panduan bagi perbincangan dan keputusan oleh Majlis.

Akta Pekerjaan Seksyen 2 (1955) menetapkan upah dengan cara berikut:

"Upah" bermaksud gaji asas dan semua bayaran wang tunai perlu dibayar kepada setiap     pekerja kontrak semasa perkhidmatan tetapi tidak termasuk:

(a)   Nilai rumah,bekalan makanan,bahan api,lampu,air , perubatan,kemudahan atau perkhidmatan yang diluluskan.

(b)   Caruman yang dibayar oleh majikan tentang kumpulan wang pencen,kumpulan wang simpanan,skim persaraan pemberhentikan kerja atau skim pesaraan telah ditubuhkan untuk memberi faedah kepada kebajikan pekerja.

(c)    Elaun perjalanan atau nilai konsesi perjalanan

Tetapi rangka kerja untuk gaji minima tidak ditetapkan.

Organisasi Buruh Antarabangsa (ILO) telah menyediakan rangka kerja dalam penentuan gaji minimum.Artikel 3 konvensyen ILO 131 atas gaji minima (1970) mencadangkan bahawa untuk menentukan tahap gaji minima hendaklah itermasuk:

(a)   Keperluan pekerja dan keluarga mereka dengan mengambil kira tahap gaji di negara ini,kos sara hidup,faedah keselamatan sosial dan taraf hidup kumpulan sosial yang lain.

 

(b)   Faktor-faktor Ekonomi,termasuk keperluan pembangunan Ekonomi,tahap produktiviti dan keinginan untuk mencapai dan mengekalkan tahap pekerjaan.

Sejajar dengan rangka kerja ini, negara-negara ASEAN seperti Indonesia,Thailand,dan Korea Selatan telah membangunkan satu rangka kerja untuk gaji minima yang mempunyai tiga faktor: makanan, bahan bukan makanan dan penjimatan (Peratusan gaji).

£  Indonesia-Undang-undang gaji minima telah menetapkan " Penubuhan gaji minima seperti yang dinyatakan di bawah Subseksyen (1) hendaklah memenuhi keperluan untuk kehidupan yang baik" (Akta No 13 tahun 2003).

£  South Korea-Gaji minima yang ditetapkan oleh Menteri Sumber Manusia dan MWC harus mengambil kira faktor-faktor berikut: a) kos sara hidup; b) gaji pekerja setanding; C) sumber produktiviti dan lain-lain.

Maksud gaji minima tidak ditetapkan dalam Rang undang-undang. Adalah  penting untuk mempunyai definisi  gaji minima kerana ia sepatutnya adalah gaji yang dapat membantu pekerja dalam kehidupan dan membaiki keluarga mereka. Gaji tidak sepatutnya dibawah garis kemiskinan, seperti yang dihadapi oleh pengawal keselamatan di negara ini. Tanpa definasi apa-apa amaun boleh dikira sebagai gaji minima. Kami mahu mencegah penyalahgunaan seperti gaji minimum tersebut dengan mendapat satu definisi yang boleh diterima pakai untuk gaji minima supaya bahawa Majlis boleh memohon.

c)                          Majlis mesti Autonomi dan Bebas

Rang undang-undang yang dicadangkan mengemukakan bahawa Ahli Majlis yang akan dilantik oleh Menteri, dan keputusannya tidak mengikat. Kami mengemukakan alternatif untuk memastikan bahawa Majlis yang Autonomi,bebas dan berkhidmat untuk membuat keputusan untuk semua pihak.

Majlis itu mesti:

  • Beroperasi sebagai sebuah badan tiga pihak dengan pihak ketiga yang bebas menjadi pengantara di antara majikan dan pekerja.

 

Kami mencadangkan satu rangka kerja tiga pihak, berdasarkan amalan yang terbaik anatarabangsa. Ia termasuk:

a)      Pertubuhan-pertubuhan majikan dan kesatuan buruh akan memilih majikan dan wakil pekerja;

b)      Bebas mesti memenuhi set kriteria, dinyatakan sesuai untuk kelayakan dan kehilangan  kelayakan :

o   Pengetahuan  dalam  pasaran buruh  atau undang-undang sumber manusia, dan pengalaman dalam analisis isu-isu nasional yang kompleks

§  Ahli akademik,peguam perindustrian,hakim-hakim yang telah bersara dan mahkamah perusahaan yang layak untuk kriteria ini.

 

o   Berkepentingan, Orang yang terhad untuk membuat keputusan.

§  Kriteria ini tidak melayakkan, antara lain, pengawai kerajaan,pesara awam yang mempunyai kepentingan kewangan dalam syarikat-syarikat.

 

c)      Calon-calon untuk Ahli Majlis bebas akan dicadangkan oleh pekerja-pekerja, majikan dan kerajaan, dengan pekerja dan majikan berhak untuk mengundi sehingga satu pertiga daripada jumlah pencalonan.

 

d)      Akhir sekali ini meninggalkan,kumpulan bebas yang boleh diterima oleh kedua-dua pihak majikan dan pekerja untuk membantu membawa angka gaji minima yang boleh diterima oleh semua.

 

e)      Wakil-wakil kerajaan yang dilantik sebagai Ahli Dewan Undangan untuk memberI maklumat dan panduan mengenai dasar,tetapi tidak akan mengundi dalam perbincangan Majlis .

 

f)       Cadangan Majlis harus mencapai dua pertiga undi penyokong Ahli Majlis sebelum dikemukakan kepada kerajaan.

 

g)      Kerajaan boleh kembalikan syor kepada Majlis untuk perbincangan. Walau bagaimanapun,keputusan Majlis yang mempunyai dua pertiga undi  secara automatik akan menjadi keputusan yang sah  bagi upah tahap hidup yang baik.

Peter Chin's open defence of the Independent Power Producers (IPPs) proves beyond doubt that the BN Government seek to protect the fat cats at the expense of the man-on-the-street

Malaysians throughout the country are taken aback by the open position taken by the Minister of Energy, Water and Green Technologies, Datuk Peter Chin in support of the current Power Purchasing Agreements (PPAs) between the Independent Power Producers (IPPs) and Tenaga Nasional Bhd (TNB).

Datuk Peter Chin has defended the country's reserve margins of 45% as an intended policy as the Government had wanted a "bigger cushion" to prevent any sudden rise in electricity demand. In fact ever since 1997, a few years after the first IPP concessions were awarded, our reserve margins have been consistently in excess of 40%. The Chief Operating Officer of TNB Azman Mohd even added that our reserve margins are expected to fall below 20% come 2015, a "dangerous level".

Today, the electricity reserve margin for Thailand and Java, Indonesia are only 25.4% and 26% respectively, is the Minister claiming that both these countries who have been attracting greater foreign direct investments than Malaysia consistently over the past 5 years do not have sufficient margins? Even in the United States and Canada, the North American Electric Reliability Corporation's ("NERC") study indicated a reserve margin of 28.6% despite being an advanced and developed country.

The Minister should perhaps enlighten Malaysians as to what makes Malaysia so special that Malaysians are forced to pay for electricity reserve margins which have been consistently close to 50% over the past decade?

In addition to defending the country's outrageous reserve margins, Datuk Peter Chin adopted the tired excuse utilised by the IPPs that they do not benefit fuel subsidies as "the fuel cost for electricity generation by both TNB and IPPs is a pass-through component", arguing that it's the end-consumers who benefit from these subsidies.

While the Minister and the IPPs are absolutely right "technically" and "legally" speaking, the subsidies have allowed the IPPs to mask the high electricity prices they sell, particularly to TNB. For example, despite subsidising less in Thailand where natural gas is sold at RM23.10 per MMBTU to IPPs compared to RM13.70 per MMBTU in Malaysia, the electricity tariffs in Thailand is similar, if not cheaper than that in Malaysia. For example, average commercial tariff rate today is RM40/kWh after the recent tariff hike compared to RM38/kWh in Thailand.

Hence despite industry consensus of the fact that the IPPs enjoy highly lucrative contract terms masked by the heavy susbidies granted by the Government, the Minister has regretfully chosen to defend these IPPs and their contracts.

This goes to show that the Government is completely insincere about its recent talks of "renegotiating" the IPP contracts and that the Minister is only buying time for the first generation IPPs to complete their PPA contracts which are expected to expire starting from 2015.
